This law creates state policies and programs to strengthen the competitiveness of micro, small, and medium-sized enterprises (MSMEs) in urban and rural areas, benefiting entrepreneurs and workers. It establishes a three-level institutional system that provides financing, training, advice, and services to improve productivity and create jobs in vulnerable sectors.

Considerations

Whereas it is a function of the State to ensure the balanced development of all production sectors and to create equitable conditions for the economic improvement of citizens.

Whereas the Strategy for Poverty Reduction is sustained by five (5) major guidelines: 1) prioritizing actions aimed at poverty reduction; 2) prioritizing actions in favor of the most marginalized groups and areas of the country; 3) strengthening the participation of civil society and decentralization; 4) strengthening governance and participatory democracy; and, 5) reducing environmental vulnerability and its impact on poverty.

Whereas micro, small and medium enterprises constitute an important factor as generators of new employment opportunities, as a factor of Small and Medium Enterprise Industry and Craftsmanship, key to the increase of production, without stability, security and education for the most vulnerable sectors of the country; and a means to promote social cohesion in urban and rural communities.

Whereas in accordance with studies conducted, the country currently presents favorable conditions for the development of Micro, Small and Medium Enterprises (MSMEs) which have been growing and constituting an effective response to the unemployed, to the increase in poverty indices and an opportunity to demonstrate the capacity for entrepreneurship and creativity that Hondurans possess.

Whereas Article 337 of the Constitution of the Republic establishes that small-scale industry and commerce shall be the patrimony of Hondurans and that their protection shall be the subject of a Law.

Whereas Decree No. 681 of October 23, 1978 and published in the Official Gazette La Gaceta on November 11, 1978, which contains the Law for the Promotion and Development of the Competitiveness of the Validity of Micro, Small and Medium Enterprises, is an instrument of governmental policy that no longer adapts to the new economic and social conditions of the country.

Whereas in accordance with the results of research studies recently conducted, there exists in the country a limited supply of business development services, in terms of quality, quantity and relevance. There also exists a limited information system regarding the activity of Micro, Small and Medium Enterprises (MSMEs), a circumstance that affects the appropriate development of programs and that hinders the complete evaluation of their impact on the economy of the country.

Whereas it is of national interest to ensure the implementation of policies, programs and financing projects, technological support, training and market management for the Micro, Small and Medium Enterprise sector (MSMEs), rural and urban, under conditions appropriate to the capacities and equitable development requirements of such sector, which shall be incorporated into the Policy for Support to the Competitiveness of Micro, Small and Medium Enterprises (MSMEs).
