Considerations
FIRST: The petition for DECLARATION OF INTESTATE SUCCESSION is GRANTED, presented by Messrs. CARLOS JOSUE VALLADARES REYES, MARIA FERNANDA VALLADARES REYES, LESLY YESCENIA REYES CABRERA, whose personal details are set forth in the preamble of this judgment.
SECOND: Let it be declared that Messrs. CARLOS JOSUE VALLADARES REYES and MARIA FERNANDA VALLADARES REYES are HEIRS AB INTESTATO of all assets, rights, actions, and obligations left by their deceased father, the decedent JUAN CARLOS VALLADARES SILVA (Q.D.D.G.), and the spousal share of one-fourth is hereby granted to Ms. LESLY YESCENIA REYES CABRERA. Consequently, the actual possession of the inheritance is granted to them, without prejudice to other heirs of equal or superior right.
THIRD: The Office Secretary shall proceed to strictly comply with article 202 of the Code of Civil Procedure regarding the publication, filing, and registration of this resolution, extending the publication notice so that the annotations, registrations, and publications required by law may be made in the Official Gazette La Gaceta or in any newspaper of greater circulation published in this Department, or by notices posted in three of the most frequented locations of the area for fifteen (15) days, and timely extending the complete certification of this judgment so that the annotations and registrations for the corresponding legal proceedings may be made. Este Juzgado de Letras Civil del Departamento de Francisco Morazán, en nombre del Estado de Honduras: PRIMERO: Declara CON LUGAR la solicitud de DECLARATORIA DE HERENCIA AB INTESTATO, presentada por los señores CARLOS JOSUE VALLADARES REYES, MARIA FERNANDA VALLADARES REYES, LESLY YESCENIA REYES CABRERA, de generales expresadas en el preámbulo de este fallo.- SEGUNDO: Declárese HEREDEROS AB INTESTATO, a los señores CARLOS JOSUE VALLADARES REYES y MARIA FERNANDA VALLADARES REYES, de todos los bienes, derechos, acciones y obligaciones, dejados por su difunto padre el causante JUAN CARLOS VALLADARES SILVA (Q.D.D.G.) y se le conceda la cuarta parte conyugal a la señora LESLY YESCENIA REYES CABRERA. En consecuencia se le concede la posesión efectiva de la herencia, sin perjuicio de otros herederos de igual o mejor derecho.- TERCERO: Que la Secretaria del Despacho proceda a dar estricto cumplimiento al artículo 202 del CPC referente a la publicación, archivo y registro de la presente resolución, extendiendo al efecto el aviso de publicación para que se hagan las anotaciones, inscripciones y publicaciones de Ley en el Diario Oficial La Gaceta o en cualquier diario de mayor circulación que se edite en este Departamento o por carteles que se fijarán en tres de los parajes más frecuentados del lugar durante quince (15) días, extendiendo oportunamente la certificación íntegra del presente fallo para que se hagan las anotaciones e inscripciones para los trámites legales correspondientes.- NOTIFÍQUESE.
