This law establishes special rules for Honduras's 2021 primary elections. It creates a provisional and final voter census based on data from the National Registry of Persons, allows citizens to challenge census errors until December 30, 2020, and requires the National Electoral Council to deliver the final voter list to political parties by January 10, 2021 to ensure clean and organized elections.

Considerations

Whereas, the Constitution of the Republic establishes the political rights of citizens to suffrage as a citizen's right and a public function, and that the vote is universal, obligatory, equal, direct, free and secret. Likewise, it determines that political parties are constituted to achieve the effective political participation of citizens.

Whereas, through electoral processes, the exercise of the political sovereignty of the people is realized to elect by means of the vote the officials who will form the bodies of Legislative, Executive government, of the Municipal Corporations and other derived instances that determine the public function.

Whereas, through constitutional reform contained in Decree No. 200-2018 of January 24, 2019, ratified by Decree No. 2-2019 dated January 29, 2019 and published in the Official Journal "La Gaceta" on February 6, 2019, a National Electoral Council (CNE) and an Electoral Justice Court were created for the exercise of the electoral function, both autonomous and independent bodies, without relations of subordination to any of the Powers of the State or matters of national security, with legal personality, jurisdiction and competence throughout the Republic.

Whereas, from this constitutional reform a Bill was derived, presented for consideration of the Plenary by the Honorable Deputy Mauricio Oliva Herrera, reported by this Commission and presented to the First Secretary of the National Congress, containing a total of 333 articles.

Whereas, of the 333 articles contained in the bill reported, seven (7) of them represent essential transitional provisions of urgent approval to guarantee the right of citizens to suffrage during the primary electoral process to be held on March 14, 2021.

Whereas, Article 205 Attribution 1) of the Constitution of the Republic establishes that it is within the power of the National Congress: to create, decree, interpret, reform and repeal laws.
