This law establishes the rules for managing, allocating, executing, and accounting for public funds intended for social projects, community initiatives, and infrastructure in Honduras. It regulates who can receive these funds (public institutions, municipalities, NGOs, private individuals), what requirements they must meet, how funds are disbursed and executed, and how they are audited. It requires all beneficiaries to submit detailed reports and provide accountability to the Court of Accounts.

Considerations

WHEREAS, in fulfillment of the representative function, deputies frequently find themselves with the need to travel to different regions of their departments and of the country in order to become acquainted with the problems that each one of the municipalities faces. In that approach with the people, deputies receive requests for support in social and infrastructure matters that have the objective of improving the quality of life of the population, but currently they do not have a fund that would help them carry out social support activities; CONSIDERING: That through Decree [number] the Organic Law of the Legislative Branch of November [date], 1936 was reformed, through which Article [number] was introduced, which creates "the Departmental Social Fund as a permanent program of social projection of deputies in all communities of their departments, intended for the execution of programs, projects, and any social aid that positively impacts the living conditions of the inhabitants." Said Article establishes that "A Special Law approved by simple majority of the deputies of the National Congress shall regulate everything related to this Fund."

WHEREAS, frequently there arise needs in the population of a social, humanitarian, and infrastructure nature that, due to the particular circumstances of the same, are not foreseen in the ordinary programs of the various institutions of the State, which makes necessary the establishment of programs of aid and special social projects to respond to the same, which may be executed both by Public Institutions of the Central Government and/or Decentralized Institutions (Municipal Corporations, National Congress, Non-Governmental Organizations, Trusts, and any Natural or Legal Person), which is why it is important to broaden the scope of application of the proposal; CONSIDERING: That in order to avoid ambiguities and guarantee greater legal certainty, it is necessary that there exist a Special Law that regulates the management, allocation, execution, liquidation, and accounting of public funds for projects of social order, community, infrastructure, and social programs; CONSIDERING: That in accordance with Article [number] (Attribution [number]), it is the authority of the National Congress to create, decree, interpret, reform, and repeal laws.
