Special Law of the National Defense and Security Council
Congreso Nacional
- Decree: 239-2011
- Published: December 12, 2011
- Issuing body: Congreso Nacional
- Gazette: 32,692
- Category: Constitutional
Summary
This law establishes the National Defense and Security Council, composed of the President, leaders of Congress, Supreme Court, Attorney General, and Secretaries of Security and Defense. The Council designs and oversees security, defense, and intelligence policies, coordinating actions between institutions to combat crimes in an articulated and efficient manner.
Considerations
Whereas Article 287 of the Constitution of the Republic creates the National Council for Defense and Security, and likewise establishes that a Special Law shall regulate its organization and functioning.
Whereas the execution of defense and security policies that correspond to the different institutions have been carried out independently without proper coordination among them, thereby making it impossible to achieve in recent years the results demanded by the population.
Whereas the work of investigation and intelligence in matters of security and defense is fundamental to combat impunity and therefore prevent crime, for which reason it must be ascribed to a special entity with functional, administrative, and financial independence.
Whereas it corresponds to the National Congress to create, repeal, reform, and interpret the Law.
Whereas the crime rates in our country demand the strengthening of the actions of public entities dedicated to the prevention, combating, and investigation of crime. Especially, because transnational organized crime has influenced national criminal groups to adopt its organized methods and apply modalities characteristic of International Organized Crime.
Whereas motorcycles are a means that organized crime and criminals use for greater efficiency and possible escape from the places where crimes are committed.
Whereas despite there being a record of regulating the use of motorcycles through a ministerial agreement, this measure has not materialized, and it is appropriate to do so through Law.
Whereas the free circulation or mobility of persons is not being limited, since the use of motorcycles is not prohibited, but rather simply regulated in its utilization.
Whereas respect for and conservation and protection of human life is the principal objective of the State and is enshrined in the Constitution of the Republic.
