Summary
This decree establishes the Honduran Federation of Mountain Sports and Climbing (FEHDME) to organize and promote this sporting discipline in Honduras. Considerations
Whereas Article 174 of the Constitution of the Republic establishes that the State shall promote the development and practice of physical culture and sports.
Whereas the right of Association is protected under Article 16 of the American Convention on Human Rights, which establishes that "All persons have the right to associate freely for ideological, religious, political, economic, labor, social, cultural, sports, or any other purpose," and likewise that "The exercise of such right may be subject only to the restrictions provided by law that are necessary in a democratic society, in the interest of national security, public safety or public order, or to protect public health or morals or the rights and freedoms of others".
Whereas in accordance with Article 60 of the Constitution of the Republic and within the sports framework, equality before the Law must be granted in the right to form Federations for different sports disciplines, to plan, direct and practice, as well as to control aspects such as: The technique and sports administration at the national level.
Whereas it is the duty of the State to promote and support the practice of various sports disciplines, not only those already in existence, but also new sports and creative options to favor especially children and young people, thereby building their physical and mental development.
Whereas the creation of the Honduran Federation of Mountain Sports and Climbing will offer the general population, and children and youth in particular, the option to practice a new sports modality that will also promote internal tourism in our country, fostering jointly the comprehensive practice of sports and culture.
Whereas in accordance with Article 205, Attribution 1) of the Constitution of the Republic, it is within the power of the National Congress: To create, decree, interpret, reform, and repeal laws.
Articles
To approve the creation of the HONDURAN FEDERATION OF MOUNTAINEERING AND CLIMBING (FEHDME), in such sense this Federation shall create and approve its respective bylaws.
To amend by addition Article 3 of the LAW FOR THE PROTECTION OF PHYSICAL CULTURE AND SPORT, contained in Decree No. 203-84, issued on October 29, 1984, published in the Official Journal "La Gaceta", on November 15, 1984, amended by addition by Decrees No. 98-87 of July 17, 1987 and published in the Official Journal "La Gaceta", on August 7, 1987; 51-93 of March 23, 1993 and published in the Official Journal "La Gaceta", on May 8, 1993; 57-95 of March 14, 1995, published in the Official Journal "La Gaceta", on May 24, 1995; 85-2000 of May 31, 2000, published on July 3, 2000; 55-2002 of March 19, 2002, published in the Official Journal "La Gaceta", on June 7, 2002 and its subsequent amendments, which shall read as follows:
Physical Culture and Extracurricular Sport in Honduras… With the same scope and the same legal and organizational nature established in the preceding paragraph, the Honduran Federation of Mountain Sports and Climbing (FEHDME) is recognized as part in the control and direction of Physical Culture and Extracurricular Sport in Honduras".
The Autonomous Sports Confederation of Honduras "CONDEPAH" shall include in its budget project for the following fiscal period, a specific budgetary item for the Honduran Federation of Mountain Sports and Climbing (FEHDME), based on the budget approved and presented by this Federation.
TRANSITIONAL PROVISION. The Autonomous Sports Confederation of Honduras "CONDEPAH" may, from its authorized budget under Legislative Decree No. 107-2021, published in the Official Journal "La Gaceta", on December 17, 2021, which contains the "GENERAL BUDGET OF INCOME AND EXPENSES OF THE REPUBLIC AND ITS GENERAL PROVISIONS, FISCAL YEAR 2022" and in its subsequent amendments; grant a budgetary allocation in favor of the HONDURAN FEDERATION OF MOUNTAIN SPORTS AND CLIMBING (FEHDME), in order that it may execute it in the present year, in expenses of materials, equipment and other implements corresponding to Mountain Sports and Climbing.
This Decree shall enter into force as of the date of its publication in the Official Journal "La Gaceta". Given in the city of Tegucigalpa, municipality of the Central District, in the Hall of Sessions of the National Congress, on the tenth day of the month of August of two thousand twenty-two.
