This decree forgives the interest and additional charges that teacher associations accumulated on their debts to INPREMA (the institute that manages teacher pensions), allowing them to catch up during one year. The associations remain obligated to pay the principal debt, which will be reorganized by INPREMA.
Considerations
Whereas the Constitution of the Republic establishes in its Article 59 that "The human person is the supreme end of society and the State", and as part of that recognition grants to that person the right to freedom of association which allows each person to organize peaceful meetings and/or to create organizations with other persons, or to join existing ones, to work in favor of common interests, in accordance with the provisions of Articles 78 and 79 of the Constitution of the Republic.
Whereas the National Teachers' Pension Institute (INPREMA), is a public law entity, created so that, through the collection of employer contributions and individual quotas, the administration and investment of its economic resources, it may provide benefits for disability, old age and death to the participants of the Teachers' Pension System.
Whereas Article 165 of the Constitution of the Republic establishes that: "The Law guarantees to teaching professionals in the exercise of their profession their stability at work, a standard of living in accordance with their elevated mission and a just retirement. …".
Whereas the Teachers' Colleges arose from the organizational need of teachers who sought to consolidate a structure that would unite an entire group of teachers with a view to improving the working conditions in which they developed their work, to stimulate their personal improvement, to regulate the exercise of the teaching profession, free from any discrimination of any kind and in this way strengthen the teachers' union -- currently the majority of these organizations maintain loans with the National Teachers' Pension Institute (INPREMA), which have accumulated substantial sums in the form of accrued interest, late payment interest and other additional charges arising from the failure to comply with their credit obligations with the National Teachers' Pension Institute (INPREMA).
Whereas at present various Teachers' Colleges maintain million-dollar debts with the National Teachers' Pension Institute (INPREMA), derived from a situation of economic insolvency which prevents them from honoring payment commitments to the National Teachers' Pension Institute (INPREMA), due to the failure to collect monthly fees from affiliated members at the national level in both the public education sector and Non-Governmental organizations, which has also resulted in the loss of death benefits to teachers and retirement insurance.
Whereas the First Honduran Professional Teachers' College (PRICPHMA), and other teachers' colleges find themselves in a precarious financial situation, since the effectiveness of Decree No. 267-2013 dated December 16, 2013, when articles were approved that limit the values collected and the method of collection that the Teachers' Organizations had and that was the guarantee offered to the National Teachers' Pension Institute (INPREMA), for two (2) mortgage loans granted, as well as the benefits to which members of the Teachers' Organization are entitled.
Whereas by means of Decree No. 18-2020 dated February 26, 2020, published in the Official Gazette "La Gaceta" No. 35,354 of August 26, 2020, an Amnesty was granted in favor of Non-Governmental Educational Centers with respect to the surcharges, late payment interest and overcharges for late payment of payroll contributions in concept of payment of worker and employer contributions owed to the National Teachers' Pension Institute (INPREMA) that have accumulated as of the publication date of this Decree, for which reason it is considered appropriate to provide an analogous opportunity to the Teachers' Colleges, which allows them to bring their credit obligations with the National Teachers' Pension Institute (INPREMA) current and to be able to safeguard their assets for the benefit of all their members.
Whereas in accordance with the provisions of Article 205 Provision 1) of the Constitution of the Republic, it is the responsibility of the National Congress to: Create, decree, interpret, reform and repeal laws.
