Summary
This decree declares an emergency in electrical service in six western Honduras departments (Lempira, Copán, Ocotepeque, Santa Bárbara, Colón, Yoro, and Olancho) due to constant blackouts affecting hospitals, schools, and businesses. It authorizes the ENEE utility company to directly contract construction and services without bidding to repair and expand electrical infrastructure, under oversight of a transparency commission.
Considerations
That the President of the Republic has charge of the General Administration of the State and the supreme direction and coordination of the Centralized and Decentralized Public Administration.
That due to the serious and prolonged problems that occur in the provision of electrical energy service under normal and acceptable conditions in the Western region of the Country, specifically in the Departments of Lempira, Copán, Ocotepeque and Santa Bárbara, in the Aguán Valley Zone, specifically in the Departments of Colón and Yoro; which has resulted in constant, sudden and nearly permanent interruptions of this service and, consequently, in the imminent risk in the provision of other vital public services in the areas of health, education, drinking water, among others, as well as the deterioration, damage and breakdown of many electrical appliances for domestic, public and industrial use, and a negative alteration in the normal rhythm of life of the population, commerce, industry, tourism and other sectors of the regional economy; all as a result of the difficulties of the National Electrical Energy Company, ENEE, in supplying its service due to insufficient electrical energy generation to supply said zone and the urgent need to repair and improve the conduction and distribution systems in order to cover the demand and satisfy the needs of the users in these regions, who have repeatedly raised their demands to the Government of the Republic to make decisions and take immediate and effective actions for a prompt response and solution to this problem that is negatively affecting the development and normal course of life of the people in these important areas of the country.
That in accordance with Article 63 of the State Contracting Law, direct contracting may be carried out, among others, when it has the purpose of meeting needs occasioned by a situation of emergency under the provisions established in Article 9 of the State Contracting Law.
That according to Article 9 of the State Contracting Law, the declaration of a state of emergency shall be made by Decree of the President of the Republic in Cabinet Council and likewise states that when emergency situations occur occasioned by exceptional circumstances that substantially affect the continuity or corporate and efficient provision of public services, the construction of public works, the supply of goods or services or the provision of consulting services that are strictly necessary may be authorized, without being subject to the requirements of bidding and other regulatory provisions without prejudice to inspection functions.

Declarar estado de emergencia en la prestación de los servicios de energía eléctrica en la Zona Occidental del País, específicamente en los Departamentos de Lempira, Copán, Ocotepeque y Santa Bárbara, en la Zona del Valle del Aguán, específicamente en los Departamentos de Colón y Yoro; y, en el Departamento de Olancho.
Instruir y autorizar a la Empresa Nacional de Energía Eléctrica (ENEE), para que, procurando las mejores condiciones de mercado y salvaguardando los intereses públicos, contrate la construcción de obra pública necesaria, el suministro de bienes o de servicios y, en definitiva, ejecute todas las acciones y adopte todas las medidas necesarias para suplir, eficientemente y en condiciones aceptables y normales, la demanda de los usuarios del servicio de energía eléctrica en estas regiones del País.- Se exceptúe de esta autorización la compra de energía térmica adicional a la ya contratada.
Todo lo anterior deberá efectuarse con la participación de los representantes de los Consejos Regionales de Desarrollo de dichas Zonas, de conformidad a la Ley para el Establecimiento de una Visión de País y la Adopción de un Plan de Nación para Honduras, contenida en el Decreto Legislativo No. 286-2009, publicado en "La Gaceta", Diario Oficial de la República el 2 de febrero de 2010.
Con el fin de lograr una transparencia y efectiva implementación del presente Decreto, se conforma una Comisión de Seguimiento y Transparencia, encargada de velar y verificar la transparencia en todo lo concerniente a los procesos de contratación y adquisiciones que se deriven de este Decreto, los cuales para todos los efectos deberán ser de conocimiento público. La referida Comisión estará integrada de la siguiente manera:
- 1)
El Presidente de la Comisión Nacional de Energía (CNA), quien la coordinará;
- 2)
Un representante de la Oficina Nacional de Auditoría Integral del Control Interno (ONADIC1);
- 3)
Un Representante de la Oficina Normativa de Contratación y Adquisiciones del Estado (ONCAE);
- 4)
Un Representante del Consejo Nacional Anticorrupción (CNA);
- 5)
Un Representante de cada una de las Regiones de las Zonas, de conformidad a la Ley para el Establecimiento de una Visión de País y la Adopción de un Plan de Nación para Honduras;
- 6)
Un Representante de cada una de las Mancomunidades de las Zonas; y,
- 7)
Los Gobernadores Políticos departamentales de las Zonas.
En todo lo anterior deberá cumplirse con lo establecido en el Artículo 9 de la Ley de Contratación del Estado.
El presente Decreto es de ejecución inmediata y deberá ser publicado en "La Gaceta", Diario Oficial de la República.
