This law creates the Military Police for Public Order (P.M.O.P.), a specialized unit of the Honduran Armed Forces designed to combat organized crime and maintain public order throughout the country, working alongside the National Police. Members receive special training, trustworthiness evaluations, and bonuses, and can be accompanied by judges and prosecutors who may work from abroad using video conferencing.

Considerations

Whereas the protection of the life and integrity of the human person in all its dimensions is an essential function of the State as established in Article 59 of the Constitution of the Republic.

Whereas the Armed Forces of Honduras are a permanent national institution of an essentially professional, apolitical, obedient, and non-deliberative character.

Whereas it is the duty of the Armed Forces of Honduras to contribute to maintaining public order and to collaborate in emergency situations to maintain peace and security of persons and their property in accordance with what is established in Articles 272 and 274 of the Constitution of the Republic.

Whereas the security crisis currently faced by the country demonstrates the necessity to create a military unit specialized in the direct combat against organized crime and common crime when these phenomena have evolved into more dangerous forms due to their methods of operation, significantly altering social peace and public order.

Whereas organized crime in all its forms has evolved in its practices and strategies as well as in the use and handling of weapons, which in many cases equals or exceeds that utilized by the Armed Forces of Honduras, representing a threat to the existence of the State and society, therefore the actions of organized crime must be considered as acts of terrorism, subversion, and insurgency.

Whereas due to its evolution and scope the actions of organized crime represent a certain and concrete attack against national sovereignty by obstructing the correct and normal functioning of justice operators, preventing the State from protecting citizens in their life and property, and it is the responsibility of the Armed Forces of Honduras to defend it.

Whereas the organizations of organized crime through their modus operandi and scope disregard, limit, and constantly attack the fundamental rights of citizens, therefore they must be considered as perpetrators of crimes against humanity and violators of Human Rights.

Whereas one of the reasons why many judges or prosecutors do not fulfill their functions as established by law is due to their personal vulnerability or that of their families before the criminal actions of organized crime, therefore it is necessary to create novel measures that strengthen the independence and impartiality in the minds of these justice operators to investigate, prosecute, and convict the criminals who form the gangs that terrorize Honduran society; consequently, special measures such as residence outside the country of these officials and hearings through electronic means of judges and prosecutors acting against organized crime must be approved.

Whereas it is the authority of the National Congress to create, enact, interpret, reform, and repeal laws.

Whereas the President of the Republic is responsible for the General Administration of the State and the supreme direction and coordination of the Centralized and Decentralized Public Administration and may, in the exercise of his functions, act by himself or in Cabinet Council.

Whereas the XVII Population Census and VI Housing Census is framed within the priorities of the Country Vision (2010-2038), National Plan (2010-2022), and that the current Government of the Republic has defined for the period 2010-2014, which is oriented toward combating poverty as the main objective, being necessary for this, to have demographic, economic, social, and housing information for the adaptation of public order policies, plans and socioeconomic projects, measurement of progress achieved in actions taken to reach the objectives set out in the Poverty Reduction Strategy (ERP) and the achievement of the Millennium Development Goals (MDGs).

Whereas the Population and Housing Census is the appropriate instrument to obtain national information that will allow for greater knowledge of the country's fundamental socioeconomic reality, for more effective development of planning and evaluation of the various programs and projects; and for the formulation of national and municipal policies.

Whereas the last Population and Housing Census was conducted in the year 2001 and, for decision-making in the public and private sectors, timely and reliable statistical information is required.

Whereas in accordance with its Constitutional Law (Legislative Decree No. 86-2000 dated July 8, 2000), the National Institute of Statistics (INE) has among its functions to organize the conducting of national censuses, agricultural censuses every five (5) years, and population and housing censuses every ten (10) years.
