Summary
This law creates a supplementary income program for residents of poor rural and urban areas in Honduras. Considerations
Whereas it is of high priority for the State of Honduras to create conditions that allow the Honduran population to guarantee minimum income levels that ensure the satisfaction of their basic needs in accordance with objectives 1 and 3 (1) of the Nation Plan for the period Two Thousand Ten, Two Thousand Twenty-Two (2010-2022).
Whereas it is of national urgency to address the lack of basic infrastructure and resolve environmental problems in the rural and urban impoverished areas of the country, which historically have been excluded from State attention.
Whereas to maximize the development of the country and to mitigate the impact of the global economic crisis of recent years, it is necessary to create opportunities that generate income in the most impoverished areas of the country, promoting material progress of the communities, sustainable development with special consideration for environmental conservation, and the solidarity actions of the inhabitants of the communities.
Whereas Articles 331 and 332 of the Constitution of the Republic guarantee occupational freedom and that the State, for reasons of public order and social interest, may reserve the right to issue measures and laws to channel and stimulate development processes based on rational planned economic or social policy.
Whereas the President of the Republic has general administration of the State, and among his attributes are the power to issue agreements and Decrees and to promulgate regulations and resolutions in accordance with the Law, in addition to directing the economic and financial policy of the State.
Whereas on December 15, 2009, Agreement No. 019-2009 was issued, published in the Official Gazette La Gaceta, with the primary purpose of authorizing the Ministry of State in the Office of Finance to enter into a distribution and sale agreement of customs forms and stamps or seals with the Ministry of State in the Office of Security so that the latter, with the income from the services rendered, may acquire the property where the Eagles' Nest Educational Center is located. WHEREAS: The Constitution of the Republic in Article 363 establishes: "All ordinary fiscal revenues shall constitute a single fund. No revenue may be created for a specific purpose. However, the Law may allocate revenues to the service of public debt and provide that the proceeds of certain taxes and general contributions be divided between the National Treasury and that of the municipalities, in proportions or amounts previously designated.
