Summary
This law creates a second Court of Appeals in La Ceiba to reduce judicial caseload. Both courts will be based in La Ceiba and aim to resolve cases more quickly.
Considerations
Whereas the Constitution of the Republic, in its article 313, establishes as attributions of the Supreme Court of Justice among other functions: "... 11) To establish the division of territory for jurisdictional purposes; 12) To create, suppress, merge or transfer Courts, Appellate Courts and other dependencies of the Judicial Branch...".
Whereas within the framework of the "Strategic Plan of the Judicial Branch 2011-2016" as Strategic Axes, one of which defines "Judicial Management" establishing as a strategic objective "To promote judicial management with excellence, quality and transparency, with emphasis on the reduction of judicial backlog", through specific actions among which stand out: Consolidation and implementation of the Judicial Management Model. Access to Justice. Implementation of programs to minimize judicial backlog. Support for specific judicial management initiatives.
Whereas currently, the Judicial Section of La Ceiba, in the department, has the existence of one (1) Sectional Appellate Court, with jurisdiction over Civil, Rental, Family, Labor, Domestic Violence, Criminal and Children and Adolescent matters, with authority in the departments of Atlántida, Colón, Bay Islands, Gracias a Dios and the Municipality of Olanchito in the department of Yoro, which has the organic structure established by the Law on Organization and Attributions of the Courts. Nevertheless, current times demand a dynamic structure that allows for efficient use of human and material resources, and in recent years the increase in the procedural workload existing in the second instance in the various matters requires additional effort from existing human talent that allows for processing and resolving cases in an agile and expedited manner, obtaining timely responses for the parties within the reasonable timeframes established in each of the procedural laws.
Whereas the workload of which the current Appellate Court of La Ceiba is cognizant has been increased due to the emergence of new legal provisions, preventing judicial processes from being processed with the necessary speed and giving the population a response to its petitions within the timeframes indicated in the Law; which makes imperative the creation of a new Appellate Court.
