This law creates the General Directorate of School Construction and Real Estate, a new department under the Ministry of Education responsible for planning, designing, and overseeing the construction, maintenance, and repair of schools in Honduras. It benefits students and teachers by ensuring adequate and functional educational infrastructure.

Considerations

Whereas it is necessary to properly organize the functioning of the units of the Secretary of State in the Office of Education, in order to make them functional and efficient in the fulfillment of the tasks and responsibilities that correspond to them.

Whereas upon the disappearance of the General Directorate of Construction and Maintenance of School Buildings in the year 1997, the Unit of National Property was created, with functions to maintain the registry and control of property, preferably furniture, equipment, and transportation units belonging to the Secretary of State in the Office of Education.

Whereas the Secretary of State in the Office of Education requires a General Directorate that shall be responsible for defining the policy on school construction; planning and directing the construction, maintenance, and repair of educational infrastructure in the country.

Whereas in addition to the foregoing it is necessary to create, in the capacity of a General Directorate, an administrative structure that shall be responsible for all matters related to educational physical infrastructure, inventory of school lands and buildings, establishment of priorities for construction and repairs of school buildings, norms, specifications and designs in school infrastructure construction, supervisions and inspections of projects constructed with national and/or external resources, plans and programs for investment in infrastructure (buildings, equipment, furniture).

Whereas the aforementioned General Directorate must be responsible for coordinating actions with national and international organizations, providing them with technical support and information for the execution of educational infrastructure projects.

Whereas with the creation of the General Directorate there will be the technical and logistical possibility to carry out projects whose investment requires the process of public and private bidding, and furthermore to make the procedures for contracting in the different projects more expeditious in order to execute the allocated funds in the corresponding fiscal period.

Whereas in light of the facts and grounds previously stated, in order to fully satisfy the interests of the Secretary of State in the Office of Education, it is necessary to make use of the human, economic, and other resources currently available to organize an independent unit of educational physical infrastructure separate from the Unit of National Property.
