Considerations
Whereas Article 247 of the Constitution of the Republic establishes that the Secretaries of State are collaborators of the President of the Republic in the orientation, coordination, direction, and supervision of the organs and entities of the national public administration, in their area of competence.
Whereas in accordance with Article 36 of the General Law of Public Administration, it is the attributions and common duties of the Secretaries of State (...) 6. "To issue the internal organization regulations of their respective departments (...) 8. "To issue agreements and resolutions in matters of their competence and those delegated to them by the President of the Republic".
Whereas on June 28, 2009, the Democratic and Constitutional Order of the Republic of Honduras was interrupted, as a result of the Political and Military Coup of State, which led to the beginning of a dark decade of grave and systematic violations of human rights including deaths, forced disappearances, arbitrary declaration of the State of exception, repression of public demonstrations, criminalization of social protests, among other grave violations of political rights described through the report "HONDURAS: HUMAN RIGHTS AND COUP OF STATE".
Whereas the Inter-American Court of Human Rights has established in its jurisprudence that, "[...] the concept of 'comprehensive reparation' (restitutio in integrum) implies the reestablishment of the prior situation and the elimination of the effects that the violation produced, as well as compensation as recompense for the damages caused", and it has also established in its jurisprudence that "reparations must have a transformative purpose of such situation, in such a way that they have an effect not only restitutive but also corrective (...) In this sense, restitution to the same structural situation of violence and discrimination is not admissible".
Whereas the Inter-American Commission on Human Rights has recognized that, in situations of grave, systematic, and prolonged violations of human rights, States may create reparation programs that allow affected persons to resort to expedited and effective mechanisms. In that sense, the IACHR has termed these efforts made by the State as "administrative reparation programs", which allow affected persons to resort to expedited and effective mechanisms.
Whereas in accordance with Executive Decree Number PCM-005-2022 dated six (6) of April of two thousand twenty-two (2022), the Secretariat of State in the Office of Social Development (SEDESOL) is created with the mandate to institute the social policies of a solidary, inclusive, and violence-free Honduras.
Whereas through Executive Decree PCM No. 017-2022, the "Social Program for Assistance to the Families of the Martyrs of Honduran Resistance" is created, in compliance with what is established in Article two (2) of Legislative Decree No. 04-2022, through which support will be provided to the descendants, ascendants, and/or dependents of the direct nucleus of victims of murder in the context of the Coup of State.
Whereas the aforementioned Decree establishes in Article 3 that the Secretariat of Social Development (hereinafter SEDESOL), shall be responsible for executing the "Social Program for Assistance to the Families of the Martyrs of Honduran Resistance", in coordination with other competent institutions, with the purpose of offering comprehensive reparation that guarantees the education and survival of beneficiaries in conditions of dignity and security, the program shall provide access to the rights and social services of: Study scholarships, pensions, justice, psychological care, dignified work, health, and housing.
Whereas through Ministerial Agreement No. 257-A-SEDESOL-2024, dated October 10, 2024, the Unit of Social Assistance was created, dependent on the Directorate of Social Innovation, which must issue a regulation for technical and financial administration, which shall also contain the liquidation parameters established by the Administrative Management, which is the same entity responsible for the administration of funds in SEDESOL.
Whereas the Secretariat of Social Development, through the Unit of Social Assistance, is responsible for the execution of the reparatory measures established in the program and shall guarantee the process of liquidation of the assigned funds, in strict compliance with the directives and procedures established by the Administrative Management.
Whereas through Legislative Decree 170-2016 that contains the Tax Code, the Customs Administration of Honduras (ADUANAS) was created, as a deconcentrated entity of the Presidency of the Republic, with functional, technical, administrative, and national security autonomy, with its own legal personality, responsible for the control, verification, inspection, and collection of customs taxes, with authority and competence at the national level and with domicile in the capital of the Republic of Honduras; and that it shall be headed by an Executive Director (a) with Ministerial rank appointed by the President of the Republic.
Whereas the aforementioned Decree indicates that the Customs Administration is headed by an Executive Director (a), appointed by the President of the Republic, through the Secretariat of State in the Office of Finance (SEFIN), with Ministerial rank, who is the highest authority and legal responsible for the institution, responsible for defining and executing administrative and operational policies, strategies, plans, and programs, goals, and results.
Whereas in accordance with the General Law of Public Administration and the Regulation of Organization, Functioning, and Competencies of the Judicial Branch --
