This law establishes a system to manage vehicles seized due to crimes, traffic accidents, or investigations. It defines clear procedures to secure, preserve, and return these vehicles to their owners or auction them if applicable, generating funds to improve storage facilities.

Considerations

Whereas, in accordance with the provisions of Article 1 of the Constitution of the Republic, Honduras is a State of law, sovereign, constituted as a free, democratic and independent Republic, to ensure to its inhabitants the enjoyment of justice, liberty, culture and economic and social well-being.

Whereas, the State recognizes domain or property as the Right to possess exclusively a thing; to enjoy and dispose of it, without further limitations than those established by Law or by the will of the owner. Administrative activity must be governed by the principles of economy, simplicity, promptness and efficiency that guarantee the functioning of public administration. The objective of the present Law must be to ensure the security, preservation and probative utility of those movable and immovable assets linked to the cause of investigation.

Whereas, the Constitution of the Republic of Honduras in its Article 59 establishes that: The human person is the supreme end of society and the State. Everyone has the obligation to respect and protect it. The dignity of the human being is inviolable.

Whereas, the State of Honduras recognizes, promotes and guarantees the existence of private property in its broadest concept of social function and without further limitations than those which for reasons of necessity or public interest are established by Law.

Whereas, the statistics handled by the Ministry of State in the Office of Security establish that the conditions for which Decree No. 91-2012 approved on June 14, 2012, published on July 12, 2012, in the Official Newspaper "La Gaceta", in its Edition No. 32,870 and its amendments, which prohibits the circulation of two (2) men on motorcycles in the national territory, at this time lacks effectiveness; since at that time there was a rate of eighty-seven (87) homicides per every one hundred thousand (100,000) inhabitants; and currently the year 2020 is closing with thirty-two (32) homicides per every one hundred thousand (100,000) inhabitants; likewise the National Police currently has seventeen thousand five hundred (17,500) personnel; in addition to the fact that said transportation is an economical means of common use by persons and families of limited economic resources.

Whereas, in accordance with Article 205 Attribute 1) of the Constitution of the Republic, it is the power of the National Congress: To create, decree, interpret, reform and repeal laws.
