Summary
This law reforms the Competition Law to create an "Administrative Clemency Program" that exempts companies from fines if they report cartels and provide evidence, as long as they cooperate and stop their participation. It also funds the Competition Commission through fees for verifying economic concentrations and a percentage of applied fines.
Considerations
Whereas economic competition is indispensable for ensuring and strengthening economic and social development, improving the competitiveness standards of enterprises for the purpose of promoting consumer welfare.
Whereas the existence of adequate conditions of FREE COMPETITION is a guarantee of consumer protection.
Whereas guaranteeing the existence of fair competition constitutes an activity of public interest.
Whereas it is the legal responsibility of the Commission for the Defense and Promotion of Competition to control monopolies, monopsonies, and oligopolies through prior verification of economic concentrations, for the purpose of achieving the objectives of the Law for the Defense and Promotion of Competition, contained in Decree No. 357-2005 of December 16, 2005.
Whereas in accordance with international best practices in the pursuit of anticompetitive conduct prohibited by nature and in keeping with the principles that inform modern legislation, it is urgent to adopt in our country an administrative procedure that is expeditious and effective for the investigation of collusive and restrictive practices of free competition (cartels), this tool of Competition Law doctrine, known as "Administrative Clemency Program or Procedure" and consisting of exempting from the payment of administrative fines those enterprises that, having been part of a business cartel, report its existence and provide sufficient evidence for investigation, provided they cease their infringing conduct and have not been the promoters of the cartel or collusive agreement.
Whereas it is the competence of the National Congress in accordance with Article 205 Attribution 1 of the Constitution of the Republic, the authority to create, decree, reform, interpret, and repeal laws.
Whereas it is incumbent upon the President of the Republic to exercise, through his Secretary of State, the direction of centralized and decentralized Public Administration, the General Administration of the State, being able to act by himself or in Council of Ministers.
Whereas in accordance with what is established in the first Article of the General Law of Public Administration, the President of the Republic must take the necessary measures to ensure that plans, policies, projects, and programs are fulfilled, for which purpose he must create or modify the strategic management bodies that he deems necessary and, when appropriate, may rely on participating private law entities to achieve the objectives of the national plan and the strategic plans derived from it, as well as the continuity of policies, projects, and programs that are mandatory for successive governments.
Whereas in accordance with Executive Agreement Number 22-DGTC-2014 dated October 23, 2014 and published on October 25, 2014 in the Official Gazette "La Gaceta," the Regulation of the Law for the Promotion and Protection of Investments was approved, which establishes in its Article 7 that the National Investment Council (CNI) in coordination with the Office of Strategy and Communications dependent on the Presidency of the Republic has the responsibility of directing the execution of the National Strategy of Image and Country Brand approved by the Government of the Republic to promote the name of Honduras in the international context as an attractive destination for investment, commerce, and tourism.
Whereas in accordance with Executive Decree in Council of Ministers PCM-066-2014 dated December 19, 2014, published on December 29, 2014 in the Official Gazette "La Gaceta," it is established in its Article 1 "To grant the category 'Country Image' established in Article 29 numeral 7) of the General Law of Public Administration; of the Secretariat of State in the Office of Economic Development to the Presidency of the Republic/Office of Communication and Strategy."
Whereas for the purposes of a quantitative improvement in the management of the COUNTRY BRAND, it is deemed convenient to unify the coordination of the COUNTRY BRAND HONDURAS STRATEGY with the actions developed in the area of international promotion of investment, exports, and tourism.
Whereas to improve the competitiveness of the country and its economic development, on March 3, 2015, the launch of the Country Brand Graphic Identity Contest was held, in order to find a work that, upon winning, represents all public and private initiatives that can promote the country with excellence for investment, exports, and tourism.
Whereas as a consequence of the foregoing, a measured and original graphic identity has been obtained through the voting of citizens and a qualifying jury designated for this purpose, together with its style manual that represents Honduras in all efforts that will be carried out in the coming years to achieve the development objectives of the State.
