Summary
This decree temporarily halts the approval of permits, contracts, and concessions for oil exploration and exploitation in Honduras until a new hydrocarbon law is enacted (maximum 1 year). It aims to ensure that interested companies wait for the new legislation to guarantee their investments comply with environmental standards and benefit the country sustainably.
Considerations
That Article 145, third paragraph of the Constitution of the Republic, establishes that the State shall preserve an adequate environment to protect the health of persons, consequently, it constitutes an obligation of the State of Honduras to promote sustainable development, promote the protection and conservation of the environment and ensure the rational exploitation of natural resources; for which it is necessary to review and update the existing legislation, as well as the formulation and issuance of specific policies in relation to resources derived from petroleum activity and its benefits for the country.
That the current Hydrocarbon Law expressly establishes that it is the exclusive responsibility of the Executive Power to formalize all principles and norms applicable to activities inherent to hydrocarbons, especially conservation of deposits and administration of reserves, optimal utilization of hydrocarbons and, ultimately, to set the policy of exploration and exploitation of Hydrocarbons, through the State Secretariat in the Offices of Natural Resources and Environment, seeking reasonable exploration and exploitation of hydrocarbons, associated with the formulation, coordination and evaluation of policies for the conservation, defense and improvement of the environment in the zones where hydrocarbon exploration and exploitation activities will be carried out and the reuse of exploited zones for the benefit of the community.
That it is imperative to issue a new legal instrument, which is already in the process of being drafted due to its priority, that contemplates the norms that order and provide, with a modern approach, the exploration and exploitation of hydrocarbons in Honduras; that also ensures equity, rational management and optimal utilization of natural resources for the benefit of the State without detriment to the right to a healthy environment of the Honduran population, for which reason the Government of the Republic, through the State Secretariat in the Offices of Natural Resources and Environment, must take all necessary and timely administrative and legal measures, so that those interested in investing in this area, national or foreign, preferably advisably or inevitably wait for the enactment of the new legislation on the matter before presenting or processing petitions related to hydrocarbons, in order to ensure the convenience, propriety and timeliness of their investment, which they must necessarily adapt to this new legislation that is already in process and thus all their efforts and all investment shall be consistent and valid.
That the State demands an adaptation to the current conditions of the international market in the matter of hydrocarbons, which allows it to attract national and international investment that generates employment, the opportunity to increase gross domestic product, energy independence, security in the supply of fuels, the right to a healthy environment and that ensures a true economic benefit for the State through the sustainable and efficient use of its natural resources.
