Summary
This decree appoints lawyer Oscar Fernando Chinchilla Banegas as Attorney General of the Republic and doctor Rigoberto Cuéllar Cruz as Deputy Attorney General for the 2013-2018 period. Both officials, elected by the National Congress, will serve their positions for five years starting September 1, 2013.
Considerations
That in accordance with amended article 22 of the Law of the Public Ministry, contained in Decree No. 228-93 dated December 13, 1993, it corresponds to this National Congress the election of the Attorney General of the Republic and the Deputy Attorney General.
That on July 1, 2013, the Attorneys Luis Alberto Rubí Avila and Roy David Urtecho López, filed their irrevocable resignation before the Plenary of the National Congress, as Attorney General of the Republic and Deputy Attorney General, respectively.
That on August 30, 2013, the National Congress received from the Proposing Board for the Election of the Attorney General of the Republic and Deputy Attorney General, the respective list of nominees.
Articles
The General Prosecutor of the Republic is elected, the citizen Lawyer OSCAR FERNANDO CHINCHILLA BANEGAS, and as Deputy General Prosecutor, the citizen Doctor RIGOBERTO CUÉLLAR CRUZ.
The citizens elected in accordance with the preceding article shall serve for five (5) years in the exercise of their positions, beginning on September 1st of the present year, after having taken the corresponding Oath of Law.
This Decree shall enter into force as of the day of its approval and must be published in the Official Gazette La Gaceta. Given in the city of Tegucigalpa, municipality of the Central District, in the Chamber of Sessions of the National Congress, on the first of September of two thousand thirteen.
