This reform allows Teacher Selection Boards to operate without representatives from teachers' organizations if they refuse to accredit them, allowing work to continue with only representatives from the Education Ministry. It benefits administrative continuity in teacher selection and evaluation when there are political conflicts between the government and unions.

Considerations

That Article 157 of the Constitution of the Republic establishes that education at all levels of the formal educational system, except the higher education level, shall be authorized, organized, directed and supervised exclusively by the Executive Power through the Secretary of State in the Office of Education.

That the Secretary of State in the Office of Education, in compliance with Article 64 of the Honduran Teacher Statute and Article 210 of the General Regulations of the Honduran Teacher Statute, has requested that the various teaching organizations accredit their principal and alternate representatives before the Departmental Selection Boards of the Departments of Santa Bárbara, Ocotepeque, Intibucá, Cortés and El Paraíso.

That notwithstanding the composition of the Departmental Selection Boards being a public function attributed by mandate of the aforementioned Article 64 of the Honduran Teacher Statute to teaching organizations, the leadership of such organizations, which are responsible for selecting the representatives in accordance with Article 210 of the aforementioned Regulations, has expressed in writing their refusal to accredit the respective representatives, given their disagreements with the current holder of the position of Secretary of State in the Office of Education.

That although the current General Regulations of the Honduran Teacher Statute establishes the selection mechanisms for the members of the Teaching Selection Boards, it does not regulate the solution mechanisms for situations such as the one in question.

That by mandate of Article 245 numeral 1 of the Constitution of the Republic, it corresponds to the President of the Republic to comply with and enforce the Constitution and the laws; as well as to issue agreements in accordance with Law.

That in accordance with the General Law of Public Administration, acts of a general nature issued in the exercise of regulatory power shall be issued by agreement.

That in strict compliance with Articles 41 and 42 of the Administrative Procedure Law, the Office of the Attorney General of the Republic has issued its Favorable Opinion Number PGR-DNC-39-2013 to this reform, by addition of two final paragraphs, to Article 210 of Executive Agreement No. 0760-SE-99, dated November 11, 1999, of the General Regulations of the Honduran Teacher Statute. THEREFORE; In exercise of the powers established in Articles: 245 numerals 1 and 11 and Article 157 of the Constitution of the Republic; Article 118 of the General Law of Public Administration and others applicable. IT IS AGREED: FIRST: To reform, by addition of two final paragraphs, Article 210 of Executive Agreement No. 0760-SE-99, dated November 11, 1999, containing the General Regulations of the Honduran Teacher Statute; which shall read as follows: Article 210: The principal and alternate representatives of the Secretary of State in the Office of Education before the National Selection Board shall be selected by the Head of said Secretary of State, from a list of high-level officials working in the same. The representatives of the Secretary of State in the Office of Education at the departmental level shall be appointed by the respective Departmental Director and one of them shall preside over it, and must work in the official sector. The principal and alternate representatives of the teaching organizations before the National Board, Departmental and District Boards, shall be selected by the Central Executive Boards of said organizations, and shall be accredited before the National Teaching Directorate Board. When the number of representatives accredited by the teaching organizations does not reach the six (6) members established by Article 64 of the Honduran Teacher Statute and Article 209 of this Regulation, due to causes exclusively attributable to the same, the National, Departmental and District Boards shall be installed with the number of representatives that are accredited to fully comply with their powers, and must leave a record and reliable proof in the corresponding registers and files of the causes attributable to the teaching organization(s). In the event that no representative is accredited by the teaching organizations due to causes exclusively attributable to the same, the Boards shall be installed with the representatives of the Secretary of State in the Office of Education to fully comply with the powers inherent to said boards, and must leave a record and reliable proof in the corresponding registers and files of the causes attributable to the teaching organizations. SECOND: This Executive Agreement shall take effect as of its publication in "La Gaceta", Official Newspaper of the Republic. Given at the Presidential House, Tegucigalpa, municipality of the Central District, on the twenty-fifth (25) day of the month of October of the year two thousand thirteen (2013).
