This agreement establishes the procedure Honduras must follow to apply safeguard measures (import tax increases) when facing economic crisis, supply shortages, or unfair trade practices. It creates an Ad Hoc Commission made up of public and private institutions that investigates, evaluates, and approves these measures before implementation, ensuring transparency and participation of affected sectors.

Considerations

That Article 247 of the Constitution of the Republic establishes that the Secretaries of State are collaborators of the President of the Republic in the guidance, coordination, direction and supervision of the bodies and entities of the national public administration, in their area of competence.

That Honduras adhered to the Convention on the Central American Tariff and Customs Regime through a Protocol that the National Congress approved by Decree No. 222-92 on December 10, 1992.

That in June of the year 1997 the updated edition of the Convention on the Central American Tariff and Customs Regime was published through the Central American Economic Integration Secretariat SIECA, in accordance with the modifications incorporated thereto by the First, Second and Third Protocols.

That Article 26 of the Convention on the Central American Tariff and Customs Regime, in accordance with the modifications incorporated thereto by the First, Second and Third Protocols, states: "When any of the Contracting States is faced with serious problems of balance of payments disequilibrium; or sudden and generalized deficiencies in the supply of raw materials and basic final goods; or market disorganization; or unfair trade practices; or any other circumstance that threatens to lead to situations of national emergency, said State is empowered to unilaterally apply the provisions set forth in Chapter VI of this Convention, related to the modification of tariff rights on imports, for a maximum period of 30 days. The foregoing, without prejudice to other non-tariff measures adopted by the States based on their national legislation. Within said period, the Council must meet to consider the situation, assess its severity and adopt measures that must be taken jointly, including the possibility of deciding on the suspension or modification of the provisions adopted unilaterally or, as appropriate, authorize the extension thereof. The period of the preceding paragraph shall be deemed extended until the date on which the Council adopts the corresponding measures."

That in order to comply with the principles of economy, speed, efficiency and transparency in administrative processes, it is imperative that this Secretariat of State implement a national procedure for the application of a safeguard measure in accordance with Article 26 of the Convention on the Central American Tariff and Customs Regime.
