It establishes who can provide DNA samples (convicted persons, suspects, victims, and volunteers), how they are collected, stored, and used to identify people in criminal, civil, or humanitarian cases, while protecting data privacy.
Considerations
The Public Ministry is an institution that is part of the State's System of Security and Justice, in which its public servants and officials develop investigative tasks directly and indirectly linked with specific aspects of national security; in this regard and given that pursuant to articles 232 and 233 of the Constitution of the Republic the Public Ministry is a specialized professional organism, responsible for the representation, defense and protection of the general interests of society, it is incumbent upon it to exercise ex officio the public criminal action, having the technical and legal coordination of criminal and forensic investigation; enjoying administrative autonomy and its leadership corresponds to the Attorney General of the Republic.
The Law of the Public Ministry establishes in article 52 the actions of the Forensic Medicine Directorate as an integral part of the Public Ministry to carry out through its experts the practice of autopsies, physical, clinical, physiological, psychological, psychiatric or other examinations in living persons, physical, chemical, biological analysis and inspection of evidence, within the forensic field that is required by the different fiscal offices of the Public Ministry, jurisdictional bodies and other competent entities involved in criminal investigation. The Forensic Medicine Directorate has within its organizational structure the Serology and Genetics Laboratory which has as its objective the performance of physical, chemical, microscopic, serological analyses including among others the analysis of genetic samples and the identification of individuals through genetic information and maintaining records of DNA profiles.
The Law of the DNA Database System, issued by the Honorable National Congress of the Republic, through Decree No. 57-2023, determined that the Public Ministry through the Forensic Medicine Directorate has the responsibility to administer the National DNA Database System, with the objective of collecting, storing and systematizing genetic information that is obtained and generated in accordance with the cases determined by said Law in order to enter the genetic profiles into the DNA databases that comprise it to facilitate the clarification of facts subject to criminal, civil or humanitarian investigation.
The Public Ministry, in accordance with the responsibilities determined by the Constitution of the Republic, by Law and the Criminal Procedure Code, has direct participation in the stages of the criminal process, conducting its activity as the actor that guarantees the ex officio procedural promotion of public criminal action; therefore, forensic genetics in the criminal process is a valuable means to resolve crimes through the examination of physical evidence at a crime scene, using knowledge about DNA to exclude suspects and identify cadavers among others; being an essential technique that complements the techniques used until now by our country, allowing in the criminal sphere to analyze criminal strategies and identify perpetrators, improving judicial and investigative management. As for civil and humanitarian investigations it is a key element to facilitate the clarification of facts to determine the certainty of the blood relationship between ascendants and descendants or the identification of missing persons and/or human remains.
It is a priority of this Attorney General of the Republic to establish the necessary mechanisms to promote the institutional modernization process and achieve the strategic objectives determined for the period 2021-2025 that allow our institution to adapt to the requirements of a modern criminal justice system through the strengthening of technical and scientific investigation capabilities, implementing new procedures, tools and investigative techniques that contribute to greater certainty regarding those responsible for criminal acts, identification of missing persons and human remains. In this regard, the Law of the DNA Database System, issued by the Honorable National Congress of the Republic through Decree No. 57-2023, establishes that, for the purposes of its application, practice and management of DNA databases, it corresponds to the Public Ministry to create its regulations; an authority which, in accordance with the Law of the Public Ministry, in its article 24, is the competence of the Attorney General of the Republic.
The Attorney General of the Republic, as required by law and through regulatory means must assume the responsibility of defining the management, use, administration and operation of the National DNA Database System administered by the Forensic Medicine Directorate through the Forensic Serology and Genetics Laboratory, as well as defining its structure and attributions. In such virtue, under the powers expressed in the Constitution and developed by the Law of the Public Ministry, it corresponds to the Attorney General of the Republic to issue regulations, orders, instructions, circulars, among others, to ensure faithful and efficient compliance with the objectives and purposes for which it was established as Representative, Defender and Protector of the General Interests of Society; therefore, in strict application of the Specialty principle, pertinent to the sources and hierarchy of administrative law, this Attorney General of the Republic, in exercise of its regulatory power, complies with the issuance of this Regulation in accordance with what is established in Decree No. 57-2023, strengthening definitively and ultimately the institutional capacity to defend the general interests of society, through the regulation of the norms for the operation, use, management and administration of the National DNA Database System with the objective of collecting, storing and systematizing genetic information that is obtained and generated in accordance with the cases determined by said Law in order to enter the genetic profiles into the DNA databases that comprise it to facilitate the clarification of facts subject to criminal, civil or humanitarian investigation.

FORMAT - SEROLOGY AND FORENSIC GENETICS LABORATORY INFORMED CONSENT SG-F-018-V03 1. INFORMED CONSENT FOR VOLUNTARY CONTRIBUTORS TO CIVIL AND HUMANITARIAN DATABASES DNA analysis allows developing an individual's DNA profile. DNA is found in any part of the body represented identically: in blood it is the same as in skin, muscles, hair, bones, among others. Human identification consists of establishing associations between DNA profiles. For this process, samples of oral mucosa or blood are required from the persons under study to obtain their DNA profiles from these samples. The DNA profile is the unique genetic information of each person that is inherited from biological mother and father. These DNA profiles can be compared for human identification or to establish paternity or kinship between individuals with a percentage of filiation according to the degree of consanguinity between the analyzed individuals. DNA profiles can be entered into Honduras's national DNA database system, other countries, or international organizations to make comparisons with other DNA profiles for human identification for civil and/or humanitarian purposes, for population studies and forensic genetic investigation cases. 2. SAMPLE COLLECTION AND RISKS The oral mucosa sample collection is done by rubbing a sterile swab against the inner wall of the cheek, in a procedure that takes a few minutes and does not generate risks for the patient.
