This law guarantees free and specialized care for patients with chronic kidney failure in Honduras through a national program coordinated by the Health Ministry. It creates prevention units, a national kidney council to oversee policies, and requires the State to allocate budget for diagnosis, treatment, transplants, and recovery in public and private facilities.

Considerations

Whereas the State of Honduras is obligated to provide the population with access to means that guarantee their fundamental right to health.

Whereas renal insufficiency is one of the cruelest diseases, which in many cases leads to death for those who do not have access to adequate treatment, leaving families with psychological consequences and a drastic reduction of their assets due to the high costs of its treatment.

Whereas in view of the deficiencies of the Public Health System, which limit it in terms of resources to offer universal services in the treatment of renal insufficiency, it is urgent to issue a special regulation that develops the fundamental right to health that patients require and creates the necessary legal and budgetary mechanisms.

Whereas it is within the constitutional authority of the National Congress to create, decree, reform, repeal, and interpret the laws.

Whereas the Constitution of the Republic in Article 205 establishes that it is an attribution of the National Congress of the Republic to approve annually the General Budget of Income and Expenditures, taking as a basis the project submitted by the Executive Branch, duly itemized, and to resolve on its modification.

Whereas the Honduras Postal Company (HONDUCOR) was created with the objective of providing Postal Service to the entire Honduran population at the lowest market prices in the country.

Whereas the National Congress of the Republic, through Decree No. 223-2012 dated January 18, 2013 and published in the Official Journal "La Gaceta", in its edition No. 33,044 of February 6 of the present year, approved the General Provisions for the Execution of the General Budget of Income and Expenditures of the Republic and of the Decentralized Institutions, which establish that in order to carry out budgetary modifications that affect allocations of capital expenditures to finance current expenditures, approval from this Branch of State is required, and the National Agrarian Institute (INA) requires a budgetary modification in order to comply with the payment of obligations acquired with personnel working therein through the System of permanent positions.

Whereas it is the exclusive attribution of the National Congress to create, decree, interpret, reform, and repeal the laws.
