Summary
This law establishes how public funds intended for social projects, community initiatives, and infrastructure in Honduras must be managed, allocated, executed, and controlled. It applies to public institutions, municipalities, congress members, NGOs, and individuals who execute health, education, housing, water, and other social assistance programs, with mandatory oversight by the Supreme Court of Accounts.
Considerations
Whereas the Constitution of the Republic establishes in its Article 4 that "The form of government is republican, democratic and representative. It is exercised by three (3) powers: Legislative, Executive and Judicial, complementary and independent and without relationships of subordination".
Whereas in fulfillment of the function of popular representation, deputies frequently find themselves in the need to travel to different regions of their departments and of the country, in order to know the problems faced by each one of the municipalities. In that approach with the people, deputies receive requests for support in social and infrastructure matters, which are intended to improve the quality of life of the population, but currently they do not have a fund that helps them carry out social support activities.
Whereas through Decree 156-2018, the Organic Law of the Legislative Power was reformed, dated November 8, 2018, through which Article 81-A was introduced, which creates "the Departmental Social Fund, as a permanent program of social projection of deputies in all communities of their departments, aimed at the execution of programs, projects and any social aid that positively impact the living conditions of inhabitants". Said Article establishes that "A Special Law approved by simple majority of the deputies of the National Congress shall regulate everything related to this Fund".
Whereas frequently needs arise in the population of a social, humanitarian and infrastructure nature that, due to their particular characteristics, are not foreseen in the ordinary programs of the various institutions of the State, which necessitate the establishment of special aid programs and social projects to respond to them, which can be executed by Public Institutions of the Central Government and/or Decentralized Bodies, Municipal Corporations, National Congress, Non-Governmental Organizations, Trusts and any Natural or Juridical Person, for which reason it is important to expand the scope of application of the proposal.
Whereas in order to avoid ambiguities and guarantee greater legal certainty, it is necessary that there exist a Special Law that regulates the management, allocation, execution, liquidation and rendering of accounts of public funds for projects of a social, community and infrastructure nature and social programs.
Whereas in accordance with Article 205 Attribution 1), it is within the authority of the National Congress: To create, decree, interpret, reform and repeal laws.
Whereas the Constitution of the Republic establishes in Article 189 that the Legislative Power is exercised by a Congress of Deputies elected by Direct Suffrage, which meets in Ordinary Sessions, in the Capital of the Republic beginning on January 25 until October 31 of each year, without prejudice to extraordinary sessions in cases provided for in Article 190 of the same.
Whereas at present there are pending study and approval several decrees of general interest for the country, which make it necessary, in an exceptional manner, to extend the period of Ordinary Sessions of the National Congress, corresponding to the Second Legislature.
Whereas in accordance with the second paragraph of Article 189 of the Constitution of the Republic, Ordinary Sessions may be extended for the time that may be necessary.
Whereas in accordance with Article 205 Attribution 1) of the Constitution of the Republic, it corresponds to the National Congress: To create, decree, interpret, reform and repeal laws.
