- Decree: 156-2018
- Published: January 9, 2019
- Issuing body: Congreso Nacional
- Category: Financial & Tax
Summary
This law creates the Departmental Social Fund so that legislators can execute social programs and projects in their communities, improving the quality of life of residents. The amount will be allocated annually in the national budget based on available capacity, and a special law will regulate its operation.
Considerations
Whereas the Constitution of the Republic establishes in its Article 4 that "The form of government is republican, democratic and representative. It is exercised by three powers; Legislative, Executive and Judicial, complementary and independent and without relations of subordination".
Whereas in fulfillment of the function of popular representation, deputies frequently find themselves in the need to travel to different regions of their departments and of the country, in order to become aware of the problems facing each one of the municipalities, and in that approach with the people, deputies receive requests for support in social and infrastructure matters, which are intended to improve the quality of life of the population, but at present they do not have a fund to help carry out social support activities.
Whereas as representatives of the people, it is necessary that deputies have a social outreach fund, intended for the execution of programs, projects and any social assistance that positively impact the living conditions of inhabitants in all communities of their departments.
Whereas in accordance with Article 205, Attribution 1) of the Constitution of the Republic, it establishes that it is within the power of the National Congress: to create, decree, interpret, reform and repeal laws.
