This law establishes how plebiscites and referendums work, two mechanisms that allow Hondurans to vote directly on important national decisions. A plebiscite consults on matters the government has not yet decided, while a referendum allows ratification or rejection of already-approved laws. Results are binding if at least 51% of citizens participate and a majority votes in favor.

Considerations

Whereas the Constitution of the Republic establishes that sovereignty belongs to the people, from whom the Powers of the State emanate, with the purpose of guaranteeing to its inhabitants justice, liberty, culture, and economic and social well-being.

Whereas in accordance with Article 5 of the Constitution of the Republic, the Government must be sustained on the principle of representative democracy from which national integration is derived, which implies the participation of all political sectors in public administration, in order to ensure and strengthen respect for Honduras based on political stability and national reconciliation.

Whereas in order to strengthen and implement participatory democracy, the Plebiscite and the Referendum have been established in the Constitution of the Republic as mechanisms of citizen consultation, whose procedure, requirements, and other necessary aspects for their exercise shall be subject to a special law.

Whereas it is the duty of the National Congress to faithfully interpret the aspirations of the Honduran People, who have entrusted us with their sovereign mandate to perform it with full awareness of our historical responsibility for the strengthening and perpetuation of a Rule of Law that ensures a politically, economically, and socially just society.
