This law allows incarcerated people with terminal and incurable diseases to be released to live with dignity in their families, hospitals, or assistance institutions. Judges use specific medical criteria (such as the Karnofsky scale) to evaluate whether someone meets the requirements, and can impose security measures if necessary.

Considerations

Whereas the human person is the supreme end of society and the State; consequently, all have the obligation to respect and protect it, especially its dignity, a right that by constitutional provision is inviolable.

Whereas penal establishments and internment centers are public institutions created for public safety and defense, in which the rehabilitation of persons deprived of liberty by judicial resolution shall be sought and their preparation for life in freedom ensured, while in all cases and at all times their human dignity must be respected.

Whereas the Law of the Unconvicted Defendant, the Code of Childhood and Adolescence, and the Criminal Procedural Code regulate access to liberty for both adult accused and convicted persons and for children and adolescents subject to internment when they are SERIOUSLY ILL PERSONS (AS) WITH INCURABLE CONDITIONS; (Terminal Phase Diseases); however, said legal provisions contain aspects that limit and hinder the work of judicial officers and Human Rights Organizations in requesting and providing this benefit, a circumstance that makes imperative the enactment of an effective Special Law that guarantees the release from custody of persons who find themselves in the aforementioned conditions.

Whereas it is appropriate to define the concept of terminal phase illness and to establish objectively and scientifically the criteria for its evaluation, in order to avoid confusion or arbitrariness.

Whereas the release of persons deprived of liberty due to their condition of terminal phase illness allows them an environment of dignity, contributing positively to their physical and mental state, and thereby enabling them to receive appropriate medical treatment in accordance with the dignity of the human person.

Whereas the purposes of preventive detention, internment measures, and the penalty of imprisonment become ineffective when imposed on persons who are in a state of terminal phase illness, a situation that causes them notorious deficiency and unbearable inferiority with respect to the rest of the inmates or internees.
