This law establishes the procedure to conduct political trials against high-ranking Honduran officials (president, deputies, magistrates, mayors) for serious constitutional violations, negligence, or incapacity. Congress is responsible for investigating complaints, guaranteeing the accused's right to defense, and voting on removal with qualified majorities. The process has two phases: a maximum 30-day investigation and voting within 5 days.

Considerations

Whereas, by means of Decree No. 231-2012, dated January 23, 2013, published in the Official Gazette "La Gaceta" of January 24, 2013, the Constitution of the Republic was reformed, including in the constitutional text the figure of Political Trial against high-ranking public officials.

Whereas, Article 234 of the Constitution of the Republic establishes: "Political Trial shall proceed against the President of the Republic and Presidential Designates, Magistrates of the Supreme Court of Justice, Deputies of the National Congress and Central American Parliament, Municipal Corporations and all public officials elected by the National Congress...".

Whereas, Article 3 of Decree No. 231-2012, dated January 23, 2013, orders the creation of legislation that shall regulate the procedure and scope under which Political Trial shall be conducted.

Whereas, the Commission for Truth and Reconciliation recommended implementing in the Constitution of the Republic the figure of Political Trial, which was fulfilled with the approval of the constitutional reform of Decree No. 231-2012 of January 23, 2013, and consequently this National Congress fulfills the responsibility of issuing the corresponding Special Law on Political Trial.

Whereas, it is within the jurisdiction of the National Congress to create, enact, reform, interpret, and repeal laws.
