This law establishes a mandatory savings fund where employers contribute 4% of each worker's monthly salary to guarantee severance or seniority payments when employment ends. The fund is administered by RAP (a private non-profit entity) and workers receive these savings plus earnings when they lose their job, retire, or pass away.

Considerations

Whereas, in accordance with Article 59 of the Constitution of the Republic: "The human person is the supreme purpose of society and the State. All have the obligation to respect and protect it. The dignity of the human being is inviolable…".

Whereas Article 127 of the Constitution of the Republic establishes: "Every person has the right to work, to freely choose their occupation and to resign from it, to equitable and satisfactory working conditions and protection against unemployment".

Whereas, in accordance with the applicable Law, the Private Contribution System (RAP) is a non-profit institution that administers resources of a private nature, with the social objective of providing financial services that contribute to improving the quality of life and socioeconomic condition of workers through worker and employer contributions.

Whereas it is important to recognize that the labor rights of workers are progressive and never regressive, especially the administration of the Labor Reserve Fund as a just compensation for the risk of unemployment, in accordance with the Labor Code, thereby guaranteeing that workers will have access to the security of their income while they achieve employment or develop a business venture.

Whereas the Constitutional Chamber of the Supreme Court of Justice declared, through a ruling of unconstitutionality in Resource No. SCO-858-2015, the total repeal of Decree No. 56-2015 of May 21, 2015, published in the Official Journal "La Gaceta" dated July 2, 2015, containing the Framework Law of the Social Protection System; a ruling that was ordered to be published by this Branch of the State and which appears in the Official Journal "La Gaceta" dated October 27, 2022, which led to the elimination of the Labor Coverage Insurance System from which the Labor Reserve Fund was derived, resulting in the current situation where employer contributions are not regulated within a legal framework for such purpose. This situation affects the benefits of labor coverage in the event of unemployment due to termination of the employment relationship.

Whereas Article 33 of the Law of the Private Contribution System (RAP) establishes that this Institution is subject to the supervision of the National Banking and Insurance Commission (CNBS) which, in order to carry out this task, must issue the corresponding special regulations and/or regulations, taking into consideration the social and non-profit nature of the Institution, ensuring its solvency and financial soundness and the good corporate governance of the Institution.

Whereas in accordance with Article 205, Attribution 1) of the Constitution of the Republic, it is the power of the National Congress to: Create, enact, interpret, reform and repeal laws.
