Summary
This decree authorizes the Government's General Directorate of Information and Press to directly contract specialized communication services, such as media advertising, promotional content, and opinion studies, without going through bidding processes. It benefits the government to execute its communication strategy efficiently and transparently.
Considerations
Whereas the Constitution of the Republic establishes that the exercise of Executive Power is held by the President of the Republic in representation and for the benefit of the people, and it is her responsibility to direct the General Policy of the State and represent it, as well as to issue agreements and decrees in accordance with law (articles 235 and 245 numerals 2) and 11)).
Whereas the General Law of Public Administration provides that the President of the Republic is in charge of the supreme direction and coordination of the centralized and decentralized Public Administration and in the exercise of her functions may act by herself or in Council of Ministers (article 11).
Whereas by means of Executive Decree PCM 023-2022 dated September 16, 2022, published in the Official Gazette "La Gaceta", in its edition 36,031, the General Directorate of Information and Press of the Government of the Republic was created, as an organ of the Central Administration attached to the Secretary of State in the Office of Strategic Planning (SPE).
Whereas the Law of Contracting of the State establishes the circumstances under which direct contracting of goods and services may be carried out, providing that it proceeds when it involves specialized scientific, technical, or artistic work (article 63 numeral 6)).
Whereas among the functions of the General Directorate of Information and Press is to subscribe contracts for the contracting of advertising spaces with conventional or alternative media of communication, whether natural or legal persons, national or foreign, all under the norms of the communication strategy of the Government of the Republic and the contracting of services for the production of inputs or advertising content and communication and press materials.
Whereas the General Directorate of Information and Press of the Government of the Republic requires EDIS ANTONIO MONCADA DAGOBERTO ZELAYA VALLE Coordinator and Supervisor Colonia Miraflores Telephone/Fax: Management 2230-2520, 2230-1821 Administration: 2230-3026 GOVERNMENT CIVIC CENTER for its proper functioning to carry out the contracting of technical and artistic specialized goods and services, with due diligence, timeliness and merit, attending to the conditions of the offer of advertising spaces and services for the production of content in the media of communication of the country.
Articles
To authorize the General Directorate of Information and Press of the Government of the Republic, attached to the Ministry of State for Strategic Planning (SPE), to carry out direct contracting for the acquisition and supply of specialized technical and artistic services in the field of communication, necessary for the proper functioning of the Directorate, specifically for the contracting of:
- a)
Advertising placement with media outlets, conventional or alternative, whether natural or legal persons, national or foreign, all under the norms of the Government of the Republic's communication strategy;
- b)
The contracting of services for the development of inputs or advertising content and communication and press materials of the Government of the Republic; and,
- c)
The contracting of monitors, measurements, surveys, advisory services, opinion studies or other technical means in the field of communication.
The present Decree is limited exclusively to the contracting of services contemplated within the powers and attributions of the General Directorate of Information and Press of the Government of the Republic.
The actions and corresponding documentation, carried out under the terms of the present Decree, shall be sent to the Institute of Access to Public Information (IAIP).
The present Executive Decree is effective immediately and shall enter into force as of its date, and must be published in the Official Gazette "La Gaceta". Given at the Presidential House in the city of Tegucigalpa, municipality of the Central District, on the 19th day of the month of January of the year two thousand twenty-three (2023).
