WHEREAS: The Constitution of the Republic recognizes in its Article 157 that "Education at all levels of the formal educational system, except the higher level, shall be authorized, organized, directed, and supervised exclusively by the Executive Branch through the State Secretary in the Office of Education, which shall administer the centers of said system that are totally financed with public funds".

Whereas it is the duty of the National Congress to create mechanisms to improve stability and administrative efficiency, as well as to consolidate academic leadership in the decision-making bodies of the National Agricultural University (UNAG), in particular the University Board of Directors (JDU), University Higher Council (CSU), as well as the Office of the Rector, due to its direct impact on governance, as well as on the quality of teaching, research, and engagement with society, fundamental pillars for achieving efficiency and effectiveness. WHEREAS: The National Agricultural University (UNAG) is established by Legislative Decree No. 192-2001, proceeding from the creation of the Demonstration Farm School, created by Legislative Decree No. 35 of January 20, 1950, which changed its name to National School of Agriculture (ENA), which occurred in Legislative Decree No. 222-93 as a decentralized entity of a State Secretary, which obtained its status as an Institution of Higher Education from the Higher Education Council through Agreement No. 314-68-95. WHEREAS: The Higher Education Council granted through Agreement No. 1058-153-2002 dated December 2, 2002, the status as part of the System of Higher Education to the National Agricultural University (UNAG), independent of the State Secretary in the Offices of Natural Resources. The National Congress approved Legislative Decree No. 172-2016, with the objective of strengthening the institutional structure, resolution of internal conflicts of the National Agricultural University (UNAG), as well as establishing its internal regulatory framework, from which its Statute emerged, published in the Official Gazette "La Gaceta" 34,525 of December 23, 2017.
