- Decree: 3-2019
- Published: October 25, 2019
- Issuing body: Congreso Nacional
- Category: Commercial
Summary
This law establishes the film industry as a sector of national interest in Honduras, creating the General Directorate of Cinematography to regulate the production, distribution, and exhibition of films. It benefits national and foreign producers with tax incentives, development funds, and facilities for filming in the country, aimed at strengthening cultural identity and generating employment.
Considerations
Whereas it is a constitutional mandate to protect all artistic and historical wealth of the country as it constitutes part of the cultural heritage of the nation as indicated by the Constitution of the Republic in its Article 172, which further indicates that "The Law shall establish the rules that shall serve as the basis for its conservation, restoration, maintenance and restitution, as the case may be".
Whereas cinematographic and audiovisual activity constitutes a cultural expression that generates national identity with significant social impact, while representing a cultural industry with special economic characteristics for the proper development of its market, but whose impact involves industrial activities of high productive potential contributing to the country's economy, considering foreign investment and job creation that such productions generate.
Whereas currently the national legislative framework used for the protection of an audiovisual work is supported only by the Constitution of the Republic in its Article 172, with its defense of cultural heritage and some elements are regulated within the Law of Copyrights and Related Rights, as well as the International Treaties of which Honduras is a party, namely, the Berne Convention for the Protection of Literary and Artistic Works, the Inter-American Convention on Copyright in Literary, Scientific and Artistic Works and the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations, each one addressing specifically the issue of cinematography, but none sufficiently to promote the development of the cinematographic industry in the country.
Whereas the issue of tourism is incorporated in the Government Plan as a priority and Honduran territory is a strategic and privileged location that must be promoted as a filming location for national and foreign films, with cinema being an optimal promotion tool to showcase the diversity of tourist destinations found in the country, as well as its history and culture.
Whereas, without adequate incentives and support from the State, the protection of national films results in high economic and technical complexity that affects their competitiveness at the national and international levels. Therefore, joint actions are required with public and private institutions in order to guarantee their functionality and effectiveness as a cultural and recreational industry of great economic, social and educational impact.
Whereas in order to access funds and worldwide organizations that contribute to the cinematographic development of developing countries it is necessary to create a legal framework that regulates its cinematography and supports national film producers.
Whereas in accordance with Article 205, Attribution 1), of the Constitution of the Republic, it is within the power of the National Congress to: Create, decree, interpret, reform and repeal laws.
