This law allows Honduran workers with high debt to consolidate their debts into a single loan with better payment conditions, through direct salary deductions. Financial institutions must provide credit access regardless of previous credit history, while employers must make deductions and transfer them promptly. The goal is to improve family finances by reducing interest rates and monthly payments.

Considerations

Whereas Article 1 of the Constitution of the Republic establishes that Honduras is a state of law, sovereign, constituted as a free, democratic and independent Republic to assure its inhabitants the enjoyment of justice, freedom, culture and economic and social well-being.

Whereas the Constitution of the Republic in its Article 331, provides that the State recognizes, guarantees and promotes the freedoms of consumption, savings, investment, occupation, initiative, commerce, industry, business contracting and any others that derive from the principles that form part thereof.

Whereas there exists high indebtedness of the national population contracted with regulated and unregulated entities and other high-cost financing schemes and that in many cases borrowers are unaware of the appropriate process to achieve amortization of their indebtedness and thus cease paying high interest percentages, which deteriorate the socioeconomic situation of their households.

Whereas it is the obligation of the State to protect, promote, disseminate and ensure compliance with the rights of workers who present high indebtedness both in commercial establishments, non-banking lenders and in the Honduran financial system, as well as to foster their inclusion and access to credit, for which reason it is necessary to create a mechanism for debt consolidation and access to credit for Honduran workers and that it be made available under favorable conditions both in terms of rate and payment terms; said mechanism must be accompanied by Financial Education, which shall be conducted by Financial Institutions, in collaboration with the business sector and monitored by the National Banking and Insurance Commission (CNBS).

Whereas in accordance with Article 205 Attribution 1) of the Constitution of the Republic it is within the authority of the National Congress to: Create, decree, interpret, reform and repeal laws.
