Summary
This decree authorizes urgent execution of protection works on the Aguán River (dredging and containment dikes) to prevent flooding that has caused deaths and economic losses for 12 years. It affects 40,000 inhabitants, 8,000 agricultural hectares, and the CA-13 highway, using 95 million lempiras through private bidding with anti-corruption oversight and community participation.
Considerations
That Articles 245 and 248 of the Constitution of the Republic grant the Constitutional President of the Republic the General Administration of the State, with powers to act in the Council of Ministers and to issue Decrees.
That in response to requests submitted by authorities, business owners, and residents of the Bajo Aguán zone, to urgently execute protective works in the area to prevent human, material, and economic losses equal to or greater than those they have been experiencing for the past 12 years due to natural phenomena; the Secretary of State in the Offices of Public Works, Transportation and Housing proceeded to verify the situation prevailing in the area, verifying objectively and proposing to suffer unavoidable consequences in the next winter season for which the possibility of the formation of 8 hurricanes and 16 storms is forecast, due to the serious siltation of sedimentation affecting the channel of 9 kilometers of the Aguán River bed, which caused that in 2008 due to the effects of tropical storm 16 the river changed its course and overflowed causing severe damage by flooding large extensions that resulted in the death of people and substantial economic losses by totally affecting agricultural production and destroying costly infrastructure works.
That to mitigate the calamity situation produced in the area, IT IS INDISPENSABLE TO DESIGN AND IMPLEMENT appropriate planning to address initially in a preventive manner and subsequently in an effective manner the situation in order to minimize the possibilities of risk; a situation that imposes on the Executive Power the responsibility to act immediately through the execution with an urgent character of prevention works, without prejudice to designing, implementing and executing a duly planned process to control the situation in the medium term.
That given the serious situation, the conclusion is that any prevention work must be EXECUTED URGENTLY within a period between the months of May to July in order to protect in a more appropriate manner a population estimated at more than 40,000 inhabitants, the agricultural production of the area which takes place in approximately 8,000 hectares, the infrastructure works composed of highway CA-13 and its bridges since it communicates with Puerto Castilla through which multiple operations of exporting national products abroad are carried out; in addition to the above protection, the works will prevent the occurrence in the area of a calamity situation that forces the State to invest resources to mitigate the situation affecting the population and rebuild the public works that are destroyed. If, on the contrary, no urgent work is carried out, the loss of human lives is unavoidable and the economic losses could exceed nine hundred million lempiras (L.900,000,000.00).
That it is the responsibility of the Executive Power to plan in advance the execution of preventive works in areas vulnerable to natural phenomena to through the Public Bidding procedure contract the corresponding works to address the situation, however, if advance planning has not been possible as has happened in the case of the situation affecting the Bajo Aguán Zone, in accordance with the provisions of article 60 numeral 2) of the State Contracting Law which provides that "when for other reasons of pressing urgency duly qualified, there arises a need whose attention could not have been planned in advance, requiring prompt and effective action so as not to hinder the provision of the service and for this reason public bidding would not be possible", the Executive Power is competent to AUTHORIZE THAT PRIVATE BIDDING BE CARRIED OUT TO CONTRACT THE URGENT EXECUTION OF PREVENTIVE WORKS.
That the Secretary of Public Works, Transportation and Housing (SOPRAVI), is the competent entity regarding the formulation, coordination and evaluation of public infrastructure works policy, which is why it has designed to immediately address the Bajo Aguán situation, the URGENT execution of the work called "CHANNELING AND PROTECTION WORKS FOR THE AGUÁN RIVER DURANGO BRIDGE SECTOR HIGHWAY CA-13" with an approximate cost of 95 million lempiras, through which the siltation of sediment affecting the Aguán River bed will be removed and containment levees will be constructed at the site where the river deviated in 2008 and at other critical sites, all with the purpose of the river returning to its original channel.
That in its objectives the Law of Transparency and Access to Public Information, in Article 2 numeral 1) guarantees the right that citizens have to participate in the management of public affairs and in numeral 5) to make effective the compliance of accountability by public entities and civil servants.
Articles
Autorizar debido a la situación apremiante que se ha constatado existe en la zona del Bajo Aguán, por no haberse planificado la contratación mediante el Procedimiento de Licitación Pública las obras de atención de la misma, la EJECUCION CON CARÁCTER URGENTE Y EN UN PLAZO NO MAYOR DE TRES MESES de la obra denominada "ENCAUZAMIENTO Y OBRAS DE PROTECCIÓN PARA EL RÍO AGUÁN SECTOR PUENTE DURANGO CARRETERA CA-13", para la cual se designa como órgano Ejecutor a la Secretaría de Estado en los Despachos de Obras Públicas Transporte y Vivienda, la cual mediante el procedimiento de LICITACIÓN PRIVADA y con una inversión de Noventa y Cinco Millones de Lempiras exactos (L.95,000,000.00), deberá proceder a contratar las obras públicas, suministros y consultorias necesarias para la realización de la obra.
Autorizar que las contrataciones que se realicen para la ejecución del presente Decreto Ejecutivo, sean a cargo del Presupuesto de la Secretaría de Estado en el Despacho de Obras Públicas Transporte y Vivienda, en la forma que establece la Ley Orgánica de Presupuesto.
La Secretaría de Estado en los Despachos de Obras Públicas, Transporte y Vivienda, dentro de un plazo de diez (10) días hábiles siguientes a la aprobación del presente Decreto, notificará al Consejo Nacional Anticorrupción el inicio del procedimiento de la Licitación Privada para la ejecución de la obra aprobada por este Decreto, a fin de que practiquen la supervisión que consideren oportuna a efectos de garantizar la realización de un procedimiento transparente.
La Secretaría de Estado en los Despachos de Obras Públicas, Transporte y Vivienda, deberá publicitar ampliamente la realización del proceso de Licitación Privada autorizado por este Decreto por todos los medios posibles, a fin de que el público en general y en particular los habitantes de la zona del Bajo Aguán se mantenga debidamente informados de su avance. Asimismo, y en aras de la transparencia se instruye a la Secretaría de Estado en los Despachos de Obras Públicas, Transporte y Vivienda, que la apertura de las ofertas presentadas producto de la Licitación Privada autorizada en este Decreto, se efectúe en la zona del Bajo Aguán con la participación de las autoridades locales y representantes de la comunidad, en carácter de observadores.
Ordenar a la Secretaría de Estado en los Despachos de Obras Públicas Transporte y Vivienda, que constituya una Comisión Especial integrada por un representante del Consejo Nacional Anticorrupción, un representante de las Municipalidades de la zona del Bajo Aguán, un representante del Colegio de Ingenieros Civiles de Honduras y un representante de la Cámara Hondureña de la Industria de la Construcción, con la finalidad de asegurar el cumplimiento de los términos del presente Decreto y que la obra se ejecute correctamente, lo anterior para hacer efectiva la participación de los ciudadanos en la gestión de los asuntos públicos y en el cumplimiento de la rendición de cuentas por parte de las entidades y servidores públicos.
El presente Decreto Ejecutivo es de ejecución inmediata y deberá ser publicado en el Diario Oficial La Gaceta.
