This decree creates PROVIVIENDA, a program under the Presidency that coordinates all government housing efforts. It unifies scattered housing institutions to formulate coherent policies, manage public and private resources, and ensure subsidies and financing for poor families needing decent housing.

Considerations

Whereas the President of the Republic is responsible for the General Administration of the State, the supreme direction and coordination of the Centralized and Decentralized Public Administration. Among his powers is the authority to direct the general policy of the State and represent it, administer public finances, create, maintain and provide public services and take measures that are necessary for the proper functioning thereof. In the exercise of his functions, he may act on his own or in Council of Ministers.

Whereas the President of the Republic, by Decree in Council of Ministers, may issue within the Centralized Public Administration the regulations required for said acts, create the internal departments that may be necessary for proper administration and reorganize those departments that the efficiency of the Administration demands.

Whereas government attention to satisfy the demand for housing is a duty and a necessity. This attention involves processes in which a multiplicity of actors intervene and, for the majority of families, it is an aspiration and the most important investment they make in their lives, placing it in turn in a preponderant role in economic activity, in investments and in job creation.

Whereas the Government of the Republic has created to date an important number of institutions and departments with the objective of addressing the housing needs of the Honduran population, which in practice has generated isolated or occasional efforts, although valuable and important; this makes it indispensable to clearly define the strategy with which the State will address the housing challenge and deficit and the demands of lower-income persons, in an orderly and coordinated manner, based on previously established guidelines and policies, considering the competencies of the participating institutions, promoting the best parameters for articulation and coordination, directing public investment, unifying the leadership of the sector, its institutionality and legal framework, concentrating efforts, optimizing resources, improving channels of dialogue, the offering of direct subsidies as one of the principal mechanisms to address the housing demand of lower-income families and other aspirations and needs required for such purpose.

Whereas in relation to what is stated in the foregoing recital: (a) by Executive Decree Number PCM-019-2002, published in "La Gaceta", Official Gazette of the Republic on the twenty-ninth (29) of November of two thousand two (2002), the General Directorate of Housing and Urban Development was created, attached to the Department of State for Public Works, Transportation and Housing, substituting in its time the Housing Programs and Projects Unit (UPPV) and which in practice dedicates itself solely to housing subsidies, executing external funds for that purpose; (b) by Executive Decree Number PCM-39-2006, published in "La Gaceta", Official Gazette of the Republic on the twenty-fourth (24) of October of two thousand six (2006) and its Reform Executive Decree Number PCM-016-2010, published in "La Gaceta", Official Gazette of the Republic on the fourteenth (14) of May of two thousand ten (2010), the Citizen Housing Program or Solidarity Credit called PROVICCSOL was created and reformed, respectively, attached to the Presidency of the Republic; (c) by Executive Decree Number PCM-008-2009, published in "La Gaceta", Official Gazette of the Republic on the thirtieth (30) of April of two thousand nine (2009) the Housing Program called "ALBA-CITIZEN POWER" was created, designed and executed by the Government of the Republic and, which by Executive Decree Number PCM-M-015-2009, published in "La Gaceta", Official Gazette of the Republic on the twenty-second (22) of October of two thousand nine (2009) was renamed "RAMÓN VILLEDA MORALES Social Housing Program", also attached to the Presidency of the Republic and, (d) other departments that are dedicated to executing efforts within the sector such as FOSOVI, BANHPROVI, FHIS, FUNDEVI and RAP.

Whereas the foregoing indicates that in practice there exist diverse institutional spaces to address the housing challenge and deficit in the country, a dispersion that does not allow for timely knowledge of the achievements and impacts achieved in favor of the beneficiary population, which is why it is necessary to create a political instance with sufficient hierarchy for decision-making in benefit of the housing sector, that is, a central and constitutionally existing department, with the establishment by the Government of the Republic, among others, of guidelines, policies, legal framework and the most suitable institutionality to develop the housing sector and, which in turn, orders, directs and coordinates all current actors and efforts of the housing sector to provide immediate responses to the population in need of dignified housing, depending that it has strictly temporary oversight, that is, until such time as it constitutes an instance that definitively leads the housing sector of the country and in which the public sector, private enterprise and related civil organizations dedicated to activities of this sector are widely represented.
