Summary
This law creates the Gender Unit of the Judicial Power, attached to the Judicial Documentation Center, to ensure equality and eliminate discrimination against women in judicial and labor processes. The unit promotes a gender perspective throughout the institution, trains officials, collects statistics, and coordinates equity policies to ensure fair access to justice for both men and women.
Considerations
Whereas the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), ratified by Honduras, establishes in its article 2, subsection e), the commitment of the States parties to adopt all appropriate measures to eliminate discrimination against women, practiced by any persons, organizations or enterprises. The CEDAW Committee, by means of its recommendation 19, established the relationship between discrimination and violence, considering that discriminatory acts can result in acts of violence, likewise acts of violence can result in discriminatory acts.
Whereas the Convention for the Prevention, Punishment and Eradication of Violence Against Women, ratified by the countries of the region, recognizes that violence against women is violence against human dignity and a manifestation of the historically unequal power relations between men and women.
Whereas through a Cooperation and Technical Assistance Agreement executed between the Judicial Branch of Honduras and the National Institute for Women (INAM) on July 21, 2008, among the commitments assumed by the Judicial Branch of Honduras in its third clause, literal A), is found the creation of the Gender Unit within the Judicial Branch for the promotion and implementation of a gender policy within the institution.
Whereas currently the Judicial Branch of Honduras through the Electronic Center for Judicial Documentation and Information (CEDIJ), has established a working group that has served as a liaison with the different institutions and organizations engaged in the gender issue.
Whereas the Electronic Center for Judicial Documentation and Information (CEDIJ) has implemented information collection formats for the generation of statistical databases with a gender approach, which allows differentiation at all levels and jurisdictional instances of this important body of information, which serves as a tool for decision-making and implementation of institutional policies.
