This agreement from the Central Bank of Honduras regulates how electronic systems work to clear and process checks between banks. It establishes clear rules on check image transmission, check truncation (eliminating physical paper), responsibilities of banks and operators, and penalties for non-compliance. It benefits customers by ensuring speed, security, and transparency in check payments.

Considerations

Whereas, in accordance with the Constitution of the Republic, the Law of the Central Bank of Honduras and the Law of Payment and Settlement Systems of Securities, it is the responsibility of the Central Bank of Honduras (BCH) to formulate, develop and execute the monetary, credit and exchange rate policy of the country and, in coordination with the National Banking and Insurance Commission (CNBS), to organize and regulate the functioning of the payment system, in such a manner that the interests of users are protected; likewise, it is the responsibility of this Institution to issue regulations and approve the necessary internal operating rules of each of the payment systems and settlement of securities.

Whereas, payment systems are essential to ensure the proper functioning of financial markets and the economy in general, therefore, it is appropriate to issue rules aimed at promoting adequate operation of such systems, in a manner that ensures compliance with international principles and standards.

Whereas, through Resolution No. 441-10/2013 of October 17, 2013, this Collegial Body last reformed the Operating Rules of the Electronic Check Clearing Chamber (CCECH).

Whereas, the Honduran Association of Banking Institutions (AHIBA) has presented to the BCH a proposal for modification to the Operating Rules of the Electronic Check Clearing Chamber (CCECH), specifically regarding the return of checks without funds, the cancellation of accounts and the truncation of checks in the CCECH.

Whereas, through Official Letter No. SEGSE-OF-549/2019 of September 13, 2019, the CNBS expressed its agreement with the proposal for reforms to the Operating Rules of the Electronic Check Clearing Chamber, since it is in accordance with best practices on the matter and complies with current legal provisions.

Whereas, the Management, having heard the opinion of the Payment System Department, through memorandum SP-968/2020, has recommended to this Board to proceed accordingly.
