This regulation establishes the procedures that PRONADERS must follow to provide social assistance to vulnerable people, communities, and organizations. It defines three types of aid (housing improvements, agricultural promotion, and institutional transfers), specifies required documentation, determines who can authorize funds, and how expenses must be executed and verified, ensuring transparency and control in public resource management.

Considerations

Whereas Article 59 of the Constitution of the Republic establishes that the human person is the supreme end of society and the State, with their dignity and well-being constituting essential foundations of public action; consequently, it is incumbent upon the State to promote conditions that contribute to the integral development of the population and to the progressive improvement of quality of life, especially of sectors in situations of poverty, vulnerability, and social exclusion.

Whereas through Legislative Decree No. 12-2000, dated March seventh (7th) of the year two thousand, published in the Official Gazette "La Gaceta" on May fifth (5th) of that same year, the Law for Sustainable Rural Development was created, establishing the legal framework to guide the actions of the State toward the integral development of the population.

Whereas the institutional mission and vision of PRONADERS guide its actions toward the design, promotion, and execution of programs and projects that promote self-management, gender equity, sustainable management of natural resources and the environment, sustainable productive development, and the generation of socio-productive infrastructure, promoting rural and urban organization and contributing to the improvement of quality of life in poor communities throughout the country, under the principles of honesty, responsibility, commitment, and equity.

Whereas, for the fulfillment of its objectives and institutional goals, PRONADERS administers and executes public resources intended for the financing of social assistance, projects, transfers, and community development actions, making it necessary to establish clear, uniform, and verifiable procedures that ensure that such resources are allocated exclusively to authorized purposes and for the benefit of the target population.

Whereas in observance of the provisions of the Institutional Internal Control Guiding Framework (MARCI) and of the norms and principles applicable to the administration and utilization of public resources, it is necessary to strengthen the mechanisms of control, monitoring, inspection, and accountability related to the execution of public funds.

Whereas in observance of the provisions of the Institutional Internal Control Guiding Framework (MARCI) and of the norms and principles applicable to the administration and utilization of public resources, the rural sector, the capitalization of the rural sector, the strengthening of community participation, and the sustainable use of natural resources are necessary, within the principles of equity, integrity, targeting, and citizen participation. Within this framework, the National Program for Sustainable Rural Development (PRONADERS) was created as an instrument for the execution of policies and strategies aimed at sustainable rural development.

Whereas through Legislative Decree No. 137-2011, published in the Official Gazette "La Gaceta" No. 32,663 dated November eighth (8th) of 2011, the Law for Sustainable Rural Development was reformed and the National Program for Sustainable Rural and Urban Development (PRONADERS) was created as a single institution, integrating the institutional structures linked to sustainable rural development, with the purpose of strengthening and expanding the intervention of the State in rural and urban communities, particularly in those with the highest levels of poverty and vulnerability.

Whereas in accordance with its legal framework, the National Program for Sustainable Rural and Urban Development (PRONADERS) has as its purpose to contribute to the improvement of quality of life in rural and urban communities, through human, social, environmental, and productive development, based on self-management and community participation, with a focus on sustainable management of natural resources, prioritizing actions directed at reducing poverty, vulnerability, and existing inequalities in the territories.

Whereas it is in the public interest that resources intended for addressing the priority needs of the population in situations of poverty and vulnerability be allocated through transparent, equitable, objective, and expeditious procedures, supported by technical and socioeconomic criteria, with adequate mechanisms for monitoring, verification, and settlement, in compliance with applicable national regulations.

Whereas Article 169 of the General Provisions of the Budget of Income and Expenditures of the Republic, Legislative Decree No. 62-2026, corresponding to Fiscal Year 2026, Reformulated, establishes that social assistance in favor of third parties, allocated in the Transfers group (50000) through public institutions, must be approved through an internal regulation, in which the type of assistance to be granted, the beneficiaries, the applicable requirements, the minimum and maximum values of assistance in accordance with the circumstances of the beneficiary, and the corresponding settlement mechanisms shall be determined and specified; making it necessary to establish the present Regulation as a normative instrument to regulate the execution of PRONADERS Social Assistance Funds, in observance of such provision.
