This statute establishes labor regulations for employees of the Public Information Access Institute (IAIP). It defines rights such as job stability, paid vacation, sick leave, and merit-based promotions; duties including punctuality, discretion, and exemplary conduct; and disciplinary sanctions ranging from warnings to dismissal based on the severity of infractions.

Considerations

That by means of Legislative Decree number 170-2006, published in the official journal La Gaceta on December 30, 2007, the National Congress of the Republic approved the Law on Transparency and Access to Public Information, subsequently reformed by said State Power through Legislative Decree number 64-2007 and published in the same official journal in execution on July 17, 2007.

That in the context of the aforementioned Law, the Institute for Access to Public Information is created as an entity with operational, decisional and budgetary independence, responsible for promoting and facilitating citizens' access to public information, as well as regulating and supervising the procedures of Obligated Institutions regarding the protection, classification and custody of public information.

That among the powers granted by the Law to the Institute for Access to Public Information is that of "Regulating, planning, organizing and carrying out its internal functioning."

That in the context of the Regulation of the Law on Transparency and Access to Public Information, published in La Gaceta on March 6, 2008, it is established that the Institute "may prepare, approve, determine and publish the Manual of positions and salaries, and the labor statute applicable to public servants of the Institute."

That in due course, a favorable opinion was obtained from the Office of the Attorney General of the Republic, with respect to the Project of the Regulation of the Law on Transparency and Access to Public Information already described.
