Summary
This policy establishes government actions to prevent and control HIV/AIDS in public and private workplaces. It protects infected workers against discrimination, promotes dialogue between employers and unions, and guarantees access to prevention, treatment, and support without stigmatization.
Considerations
That in the HIV epidemic one of the main obstacles to reducing prevalence is stigma and discrimination, an aspect that hinders access to prevention, care, support and treatment services and that social determinants such as lack of education, poverty among others, increase the risks of HIV infection.
That at the national level the National Policy on HIV and AIDS responds to the III National Strategic Plan for response to HIV and AIDS PENSIDA III 2008-2015 and is framed in the legal instruments that regulate HIV and AIDS such as: The Special Law on HIV and AIDS and its Regulation and the General Regulation of Preventive Measures for Work Accidents and Occupational Diseases. WHEREAS: That the State of Honduras has enacted legislation, and is a signatory to international instruments aimed at protecting the fundamental rights of workers in the world of work, therefore it is necessary to approve a National Policy on HIV and AIDS in compliance with the principles framed in the Country Vision 2010-2038 and the Plan of the Nation 2010-2022 of the Government of the Republic. THEREFORE; In application of Articles 245, numerals 2 and 11, 252 of the Constitution of the Republic, Articles 11, 17 and 22 numeral 9) of the General Law of Public Administration; and Articles 10, 11 and 13 of the Regulation of Organization, Operation and Competencies of the Executive Branch. IT DECREES: Article 1.- To approve as Government Policy, in all and each of its parts, the "National Policy on HIV and AIDS in the World of Work" contained as Annex I to this Decree, which is based on guiding the constituent organizations, associations and other strategic partners, in the generation of processes linked to universal access to prevention, care, treatment, support and assistance; as well as to mitigate and control the impact of the epidemic in the workplace, in the public, private and informal sectors, within the framework of human rights (labor, sexual and reproductive) with a gender approach, including sexual orientation and gender identity, multiculturalism, without stigmatization or discrimination of any kind in the context of the national response. Article 2.- The general objective of this Policy is to promote gradually and progressively in the labor sphere the conditions that contribute to the respect and fulfillment of human rights, particularly equality of opportunities and treatment for people living with HIV in order to foster an effective response to the epidemic. Article 3.- The specific objectives are among others: a. Promote and build spaces for permanent dialogue at the highest level, among civil society, government bodies, private enterprise, trade union organizations and international cooperation, in the processes of strategic planning of the policy, for decision-making in the context of the national response to HIV and AIDS in the world of work. b. Promote the application of conflict resolution procedures in a coordinated manner with public or private institutions, that are easily accessible and that guarantee reparation of damage to workers in case their rights are violated. c. Facilitate the process of empowerment regarding HIV and the world of work, among workers and their organizations in order to incorporate in their collective agreement or other instruments that govern the labor relationship, clauses regarding HIV and AIDS and non-discrimination. d. Manage prevention programs on HIV and AIDS for the working population, with particular attention to people most exposed to risk, in all public and private companies, as well as in workers' organizations. e. Establish mechanisms to review and reform national legal frameworks based on the recommendations of the ILO and other international bodies that address the issue of HIV and AIDS in the world of work, with the participation of the different sectors involved. f.
