This law establishes the procedure for applying sanctions (fines, facility closures, confiscation, or permit revocation) to people and companies that violate radiological and nuclear safety regulations in Honduras. Violations are classified into three severity levels, and sanctions are adjusted considering mitigating factors (good compliance history) or aggravating factors (repeat offenses, negligence). The purpose is to protect public health, property, and the environment in radiation-related activities.

Whereas through Executive Decree No. PCM-048-2017, published in the Official Gazette La Gaceta on August 7, 2017, "Article 1. The Secretariat of State in the Office of Energy is created, Governing Institution of the national energy sector and regional and international energy integration, the regulation, control and supervision of activities of transformation, storage, transport, distribution, commercialization and supply of fuels derived from petroleum, biofuels or energy carriers, which, among other matters, comprises but is not limited to the following aspects [...] q. the regulation, control and supervision of nuclear activity, management of radioactive sources, nuclear energy, safety of facilities and radiological protection". Article 3. Reorganization. [...] The General Directorate of Radiological Safety established through Executive Agreement No. 006-2016 is hereby attached to the SEN (Secretariat of State in the Office of Energy)".

Whereas through Executive Agreement No. 73-2019, published in the Official Gazette La Gaceta on February 1, 2020, the General Regulation for the Implementation of the Law on Nuclear Activities and Radiological Safety is approved, which establishes in articles 83 through 98 all the activities that are subject to sanctions and infractions for Non-Compliance with Legal, Regulatory and Normative Provisions on Radiological and Nuclear Safety.

Whereas it is the duty of the State of Honduras through the Secretariat of State in the Office of Energy via the General Directorate of Radiological Safety to regulate, enforce, control and supervise nuclear activities, the use of radioactive sources, nuclear energy, safety of facilities and radiological protection which constitute essential aspects for national development, as well as to ensure radiological and nuclear safety in nuclear activities conducted in the country, and the application of coercive action arising from non-compliance with the Law on Nuclear Activities and Radiological Safety and its regulations.

Whereas the Secretariat of State in the Office of Energy, through the General Directorate of Radiological Safety (DGSR), has the authority to establish procedures for the application of sanctions and infractions, in order to comply with the provisions established in the Law on Nuclear Activities and Radiological Safety and its regulations.
