Considerations
Whereas, in accordance with Article 245, numeral 2 of the Constitution of the Republic, the President of the Republic has charge of the General Administration of the State and among other powers has the authority to direct the general policy of the State and represent it.
Whereas, the policy, strategy and objectives related to the general management of the State are defined by the President of the Republic and his actions are discussed and approved through the Council of Secretaries of State.
Whereas, in accordance with Article 4 of the General Law of Public Administration as amended by Legislative Decree No. 266-2013, the creation, modification or suspension of the Secretaries of State or of Decentralized Organisms or Entities can only be carried out by the President of the Republic in Council of Secretaries of State.
Whereas, in accordance with Article 14, numeral 1 of the General Law of Public Administration, as amended by Legislative Decree No. 266-2013, the President of the Republic, by Decree in Council of Secretaries of State, may issue within the Centralized Administration the norms required to determine the competence of the Offices by the Secretaries of State and create the internal dependencies that may be necessary for proper administration, and furthermore these provisions may be issued by the President of the Republic in Council of Secretaries of State even when the dependency or function has been created or granted by means of a legal provision.
Whereas, as established in Article 45 of the General Law of Public Administration, decentralized organs or entities shall be created, modified, merged or suppressed by Decree of the President of the Republic in Council of Secretaries of State and their heads shall be responsible for their administration to the dependency of the Centralized Administration on which they depend.

Whereas, in accordance with Article 43 of the General Law of Public Administration, functional decentralization is verified through the creation of entities or organs which, notwithstanding the fact that they depend hierarchically on a central organ, are attributed their own competence, which they exercise with technical, administrative and financial autonomy.
Whereas, the Constitution of the Republic in Article 340 establishes as a matter of public utility and necessity the management, protection, restoration and technical and rational exploitation of the nation's natural resources, and such use must be regulated in accordance with the social interest, seeking a balance between socioeconomic development and the protection of environmental resources.
Whereas, the strategic guidelines of the Government Plan 2018-2022 "Honduras Advances with Firm Steps" establish among its lines of action the reduction of poverty through the generation of rural employment, the development of productive sectors; the adaptation to and mitigation of climate change in order to achieve the integral development of the Honduran population, for which it is necessary to direct State actions toward the capitalization of the rural sector as a means to directly and decisively address the problem of poverty and the deterioration of natural resources, sustaining these efforts on the principles of equity, integrity, focusing and citizen participation.
Whereas, the State of Honduras is a signatory to various International Treaties and Conventions aimed at protecting health and the environment from emissions and releases carried out by human beings; keeping the increase in global temperature well below 2°C, increasing the capacity for adaptation to the adverse effects of climate change and promoting climate resilience and low-carbon development; promoting the fair and equitable participation of the benefits derived from the use of genetic resources; promoting shared responsibility and the joint efforts of the Parties in the field of international trade in certain hazardous chemical products in order to protect human health and the environment against potential harm; protecting biological diversity through the administration of movements between countries of living organisms modified among other matters of equal importance.
Whereas, it is urgently necessary to order the functioning of all the institutional framework that has direct or indirect responsibility for the protection, management and sustainable use of the resources water, soil, forest and biodiversity, avoiding the duplication of functions, and improving its efficiency and effectiveness in the fulfillment of the functions of each.
Whereas, it is necessary to have an instance that ensures that all institutions called upon to contribute to the fulfillment of the commitments and responsibilities that the country has acquired with the Conventions and Treaties are complied with.
