Considerations

Whereas, in accordance with Article 235 of the Constitution of the Republic, the President of the Republic exercises the authority of the Executive Power in representation and for the benefit of the people.

Whereas, in accordance with Article 245, Numerals 2, 11, 30, and 45 of the Constitution of the Republic, among the powers of the President of the Republic are to direct the general policy of the State and represent it, to issue, among others, Executive Decrees and Agreements in accordance with the Law, to direct the economic and financial policy of the State, and the other powers granted by the Constitution and the laws.

Whereas, in accordance with Article 11 of the General Law of Public Administration, the President of the Republic has charge of the supreme direction and coordination of the Centralized and Decentralized Public Administration, and in the exercise of his functions may act by himself or in Council of State Secretaries.

Whereas, the General Law of Public Administration, in its Articles 3, 6, 11, 14, 22, 116, 117, and 119, establishes that the organization and operation of the Public Administration must be oriented toward the satisfaction of the general interest, under principles of legality, efficiency, economy, coordination, continuity of service, transparency, and rationality in the use of public resources, granting the Executive Power the authority to create, modify, merge, divide, or suppress dependencies, as well as redistribute institutional competencies when necessary for better public management.

Whereas, it corresponds to the State Secretary in the Offices of Infrastructure and Transportation (SIT), in accordance with current legal provisions, the formulation, coordination, execution, and evaluation of policies related to public infrastructure works and other matters included within its scope of competence.

Whereas, by Legislative Decree No. 12-90, dated March 2, 1990, the Honduran Social Investment Fund (FHIS) was created, whose legal validity is established until December 31, 2026, in accordance with the reforms made by Legislative Decree No. 118-2022.

Whereas, by Executive Decree Number PCM-004-2026, published on February 25, 2026, in the Official Gazette "La Gaceta", in its Article 11, the Honduran Social Investment Fund (FHIS) was attached as an internal dependency of the State Secretary in the Offices of Infrastructure and Transportation (SIT); and, establishing likewise that the projects, programs, and initiatives that were in execution of the abolished State Secretary in the Offices of Community Development, Water and Sanitation (SEDECOAS), would be executed henceforth by the SIT.

Whereas, Article 16 of the related Executive Decree PCM-004-2026 instructs to present henceforth and in a progressive manner, the definitive organizational structure of the State Secretaries and other institutions contained in Articles 4, 5, 7, 8, 9, 10, 11, 12, 13, 14, 15, and other applicable provisions of that Executive Decree or other State Secretaries, institutions, or dependencies that may be considered, for their corresponding approval by the President of the Republic by himself or through the Council of State Secretaries, complying in the present case and with the present Executive Decree with this instruction, in specific relation to the State Secretary in the Offices of Infrastructure and Transportation (SIT).

Whereas, in light of the competencies attributed to the State Secretary in the Offices of Infrastructure and Transportation (SIT) and the need to strengthen its institutional capacity for the management of social investment programs and projects, it is necessary to incorporate within its organic structure a specialized General Directorate in this matter, which will strengthen the technical capacity of the State Secretary in the Offices of Infrastructure and Transportation (SIT) for the planning, formulation, coordination, technical management, supervision, and monitoring of social investment programs and projects that correspond to its scope of competence.
