Honduras declares a 6-month migration emergency to protect citizens abroad. It creates the National Emergency Strategy (ENEPROMIH) that provides free legal advice, document access, medical and psychological care to undocumented migrants in the United States, and grants bonuses, training, and loans to deported citizens returning home.

Considerations

Whereas, in accordance with the Constitution of the Republic, the Executive Power is exercised in representation and for the benefit of the people by the President of the Republic, who is responsible for directing the General Policy of the State and representing it, as well as issuing Agreements, Decrees, issuing Regulations and Resolutions in accordance with the Law (articles 235 and 245, sections 2 and 11).

Whereas the Constitution of the Republic establishes that the human person is the supreme end of society and the State, and all have the obligation to respect and protect it. Likewise, it establishes that migration shall be conditioned to the social, political, economic, and demographic interests of the country (articles 35 and 59).

Whereas the General Law of Public Administration provides that the President of the Republic has responsibility for the supreme direction and coordination of the Centralized and Decentralized Public Administration. The President of the Republic in the exercise of her functions may act by herself or in Council of Ministers (article 11).

Whereas in accordance with what is established in the General Law of Public Administration, the Secretaries of State are collaborators of the President of the Republic in the dispatch of public affairs and in the orientation, coordination, direction, and supervision of the organs of the Centralized Public Administration and the coordination of decentralized entities and organs or decentralized institutions, in the areas of their competence (article 33).

Whereas the General Law of Public Administration determines that the acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions, or Providences (article 116).

Whereas in accordance with the Vienna Convention on Consular Relations, consular functions comprise the protection in the receiving State of the interests of the sending State and of its nationals, providing them with aid and assistance, within the limits permitted by international law (article 5).

Whereas the provisions of the Law for the Protection of Honduran Migrants and their Families are of public order and have as their purpose, among others, to establish the norms and conditions to make it possible for Hondurans abroad to exercise their constitutional rights, as well as to establish the legal framework within which the State of Honduras must exercise its protective action in favor of Hondurans abroad.

Whereas through Legislative Decree No. 106-2013 published in the Official Gazette "La Gaceta" on February 15, 2014 in edition 33,356, the Solidarity Fund for the Honduran Migrant (FOSMIH) was created, which shall be financed and executed by the Secretary of State in the Office of Foreign Relations and International Cooperation (SRECI), which shall include it in its annual budget. Likewise, through a reform made to the aforementioned Decree, through Legislative Decree No. 54-2024 published in the Official Gazette "La Gaceta" on July 23, 2024 in edition 36,593, it was established that the annual budgetary allocation of FOSMIH shall be TEN MILLION DOLLARS (USD 10,000,000.00) of the United States of America (article 29).

Whereas Human Mobility has existed historically in humanity and the displacement of persons whether within or outside our country (migration) is a reality exacerbated by the implementation of a neoliberal economic model whose purpose has been to deepen inequalities, dependency, environmental deterioration, violence, as well as major blockades and sanctions that are detrimental to development at the regional level, and which as a product of public-private corruption and the hoarding of wealth inherent to the capitalist system resulted in major consequences of indebtedness that impoverished our country for more than a decade.

Whereas at the global level, an increasing number of migrants are forced to abandon their homes due to a complex combination of factors. In accordance with data from the International Organization for Migration (IOM), from 1990 to the year 2024, the number of Honduran migrants has increased from 156,000 to 985,000, with the United States of America being the principal destination country.

Whereas it is currently estimated that there are 1.8 million Hondurans in the United States, of which the Department of Homeland Security (DHS) of the United States of America registers, as of the month of November 2024, a number of approximately 261,651 with deportation orders who are not in custody of the Immigration Service of the United States, and approximately 1,349 Hondurans with deportation orders who are in custody of said entity, according to official data from ICE (Immigration and Customs Enforcement of the United States of America).

Whereas through Executive Decree number PCM 21-2024, published in the Official Gazette "La Gaceta" on August 6, 2024, in edition 36,605, the Council of Migration Governance was created as the governing entity in the coordination, consultation, advisory, and analysis for migration governance in Honduras. The foregoing in compliance with the Bicentennial Government Plan to Refound Honduras and build the Socialist and Democratic State, which recognizes migration as a human right and points to the responsibility of planning all state public policies, which includes in migration matters, creating and institutionalizing a strategic interinstitutional political mechanism that advises the Presidency of the Republic and that establishes a framework of thematic and institutional governance.

Whereas forced return migration to the country is a central characteristic of migration trends in Honduras, which implies significant risks in terms of security that are worsened by limited access to civil documentation and the weakness of return and reintegration programs.

Whereas despite a reduction from the year 2022 to the year 2024 in deportations of Hondurans from the United States by at least fifty percent (-50%), the changes in the dynamics of migration policies that have begun to be implemented by President Donald Trump, necessitate the adoption of urgent measures for the mitigation of the negative impact of said policies on our country.

Whereas various countries in Latin America are preparing to face the social, economic, and political repercussions resulting from the hardening of migration policies on the part of the United States of America, therefore it is necessary that the State guarantee an efficient, effective, and capable response through a protection strategy that includes programs, projects, and actions in favor of Honduran migrants abroad.
