Considerations
Whereas the Constitution of the Republic establishes that the Executive Power is exercised by the President of the Republic in representation and for the benefit of the people, who is responsible for directing the General Policy of the State and representing it, as well as issuing Agreements and Decrees in accordance with law, adopting measures for the promotion, prevention, recovery and rehabilitation of the health of the inhabitants (articles 235 and 245, numerals 2, 11 and 29).

In that sense, the Constitution establishes that the right to life is inviolable, recognizing in such a manner that the Constitution of the Republic consecrates the right to protection of the health of the Honduran population, which is a condition of the right to life which is inviolable and it is the duty of all to participate in the promotion and preservation of health and of the community and it is the duty of the State to maintain an adequate environment to protect the health of persons (articles 65 and 145).
Whereas the General Law of Public Administration provides that the President of the Republic has under her charge the supreme direction and coordination of the Centralized and Decentralized Public Administration and in the exercise of her functions may act by herself or in Council of Ministers (article 11).
Whereas in accordance with the Constitution of the Republic, the President convokes and presides over the Council of Ministers, which may take resolution in all matters that she deems to be of national importance (article 252, second paragraph).
Whereas in addition to the public calamity caused by the shortage of medicines and essential medical-surgical materials and the carrying out of several processes for the acquisition of these medicines and supplies, several of which some have been partially declared failed or desert, is added the delay in the process of acquisition of certain medicines and medical-surgical materials in the national and international market, making it materially impossible to replenish the health system at the national level during the year 2022.
Whereas ordinary purchasing processes require considerable time for their completion, putting at serious risk the health of citizens in severe and critical condition, who urgently demand the medicines and medical-surgical materials that have not been acquired to date by the Ministry of Health.
Whereas in accordance with the State Contracting Law, the declaration of a state of emergency shall be made by Decree of the President of the Republic in Council of Ministers (article 9).
Whereas by Executive Decree number PCM 16-2022 dated June 10, 2022, published in the Official Gazette "La Gaceta" in its edition number 35,946, a STATE OF HEALTH EMERGENCY was declared throughout the National Public Health System at the national level for the year 2022, with the purpose of guaranteeing compliance with the constitutional right to health, ensuring the provision of services, supplies, medicines and timely care of the population.
