This law requires Honduras to use energy efficiently and rationally to reduce costs and protect the environment. It creates the General Directorate of Renewable Energy and Energy Efficiency, a financing fund for energy-saving projects, and requires new equipment to have labels showing energy consumption. It affects businesses, industries, buildings, and drivers, aiming to lower costs and emissions.

Considerations

Whereas, the Constitution of the Republic of Honduras in its

Whereas, to counteract high energy consumption and reduce environmental impacts, the State of Honduras subscribed to the 2030 Agenda of the Sustainable Development Goals (SDGs) at the Seventieth (LXX) General Assembly of the United Nations (UN), held in September 2015, which addresses the social, economic and environmental dimensions that must be adopted. Among them is SDG 7 Affordable and Clean Energy, which seeks to "Guarantee access to affordable, reliable, sustainable and modern energy for all".

Whereas, Executive Decree Number PCM-048-2017, dated August 7, 2017, published in the Official Gazette "La Gaceta" of the same date, establishes the Secretariat of State in the Office of Energy (SEN) as the governing institution of the national energy sector and of regional and international energy integration, responsible for proposing to the National Energy Council the National Energy Strategy and policies related to the comprehensive and sustainable development of the energy sector; it is likewise responsible for the formulation, planning, coordination, execution, monitoring and evaluation of the strategies and policies of the energy sector.

Whereas, the Secretariat of State in the Office of Energy (SEN) is responsible for short, medium and long-term energy planning for the country, aligned with the national energy policy; likewise, for generating strategies to increase and guarantee access to energy sources or services for the entire population as an enabler of socioeconomic development; it is likewise responsible for the issuance, administration and monitoring of a regulatory framework for an efficient and modern energy system and which includes the supply of electrical energy as a strategic resource, of national security and a human right of an economic and social nature.

Whereas, the increase in international oil prices and their derivatives leads to an increase in all energy products, which is expected to continue in the medium and long term, in addition to the fact that the processes of transformation and final use of energy generated with fossil fuels have an additional social cost due to their negative impacts on the environment.

Whereas, it is the duty of the State, in coordination with private enterprise, to reduce the economic and social impact of price increases as well as the harmful effects on the environment, resulting in the obligation to improve efficiency and rationalize the processes of transformation and final use of energy.

Whereas, the markets for equipment of all kinds, as well as the behavior of producers and users show great resistance to change, which makes it necessary to educate all those involved in energy processes and promote the introduction of new technologies in the market that allow efficient energy use.

Whereas, the pricing systems of the various energy products, as well as subsidy plans for small consumers, must be coordinated with each other, in order to ensure that the economic signals transmitted by prices and subsidies induce efficient use and substitution of energy products.

Whereas, the markets for equipment that consumes energy, as well as the resistance to changes in the consumption patterns of producers and users, makes it necessary to educate all those involved in energy processes and promote the introduction of new technologies in the market that allow efficient energy use, the democratization of its generation and the involvement in generation by communities, indigenous peoples and people of African descent, should they so wish.

Whereas, in accordance with Comparative Law, by the year 2019, ten (10) countries in the Latin America and Caribbean region already had in force laws on energy efficiency or rational and efficient energy use, and there are six (6) other countries that have an Energy Efficiency Bill that is under discussion. In Honduras there have been attempts in previous periods to approve this regulation without completing that process. Among the South American countries that already have energy efficiency regulations are: Brazil, Colombia, Venezuela, Peru and Ecuador; in Central America the countries that have already approved the Energy Efficiency Law are: Panama, Costa Rica and Nicaragua, and finally in North America Mexico, which already has such regulation.

Whereas, in accordance with
