This law establishes a transparent and rigorous system for selecting candidates for the Supreme Court of Justice. A Nominating Committee composed of 7 members from different institutions (Court, lawyers, human rights, business, universities, civil society, and workers) evaluates applicants through tests, interviews, and background checks, presenting Congress with a list of at least 45 candidates emphasizing merit, ethical integrity, and professional experience, while guaranteeing gender parity.

Considerations

Whereas the independence of the Judicial Branch derives from the essential elements of the Rule of Law, in particular from the principle of separation of Powers; which implies that the Constitution of the Republic, international treaties on human rights, domestic law, and the policies of the State of Honduras must guarantee that the justice system is truly independent from the other Powers of the State, so that society has the certainty that it has magistrates and judges who act and resolve exclusively on the basis of the current legal order, without external interference in their mandates and competencies.

Whereas the Constitution of the Republic establishes in its Article 303 that justice is administered by independent magistrates and judges, solely subject to the Constitution and the laws, which is consistent with the American Convention on Human Rights (Article 8.1) and the International Covenant on Civil and Political Rights (Article 14), which recognize as a justiciable human right that every case be submitted before judges and independent, impartial courts that are established beforehand.

Whereas the independence of the judiciary is an essential principle in a democratic State, whose components range from institutional design to its effective independence, both from other Powers of the State and from factual spaces of power, legal and illegal.

Whereas judicial independence can only be guaranteed if the procedure for the selection of judges and magistrates, beginning with those of the Highest Court of the Republic, is carried out through the organization and functioning of a Nominating Board whose actions result in a list that reflects, in each of the proposed candidacies, the primacy of merit, profound knowledge of Law, professional and personal record without blemish, and the autonomous judgment of each of its members.

Whereas the deficiencies of the existing legislation on the matter, stipulated in the Constitution of the Republic and developed in Decree No. 140-2001 dated September 25, 2001, published in the Official Journal "La Gaceta" dated October 5, 2001, containing the Organic Law of the Nominating Board for the Election of Candidates for Magistrates of the Supreme Court of Justice, make it necessary and urgent to require a new law regulating the organization and functioning of the Nominating Board, which introduces the necessary elements to guarantee that in its composition the suitability requirements demanded for those evaluated are respected, that the weighting factors emphasize elements relevant to the position to be performed, and that the evaluation criteria are rigorous, susceptible to objective measurement and supervision, and that the procedural rules ensure the nomination of the most suitable candidates.

Whereas in accordance with Attribution 1 of Article 205 of the Constitution of the Republic it is the power of the National Congress to: create, enact, interpret, reform, and repeal laws, and in application of Article 311 of said legal document, which orders the issuance of a law that regulates "The organization and functioning of the Nominating Board".
