This is widely recognized, whether from a humanistic perspective, which aims at greater protection of those in special conditions of vulnerability, or from an ethical perspective, which holds that only adequate protection of the child guarantees the formation of a healthy, free and autonomous adult (Article 55, United Nations Charter).
Whereas for the implementation of an Early Warning Alert System it is necessary to establish a normative framework that determines the attributions of the authority to carry it out, for the prompt and effective recovery of missing or kidnapped children or adolescents, with the assistance of the state, civil society, NGOs, media and any other entity willing to collaborate with this Early Warning Alert System.
Whereas it is essential to create regulations intended to prevent the continuation of criminal acts against children and adolescents, subjects deserving of special protection by the State, society and family; and the AMBER alert as a prevention mechanism has demonstrated its preventive efficacy in preventing harm to children and adolescents.
Whereas it corresponds to the National Congress the power established in Article 205, Attribution 1) of the Constitution of the Republic to create, decree, interpret, reform and repeal laws.
Whereas the Constitution of the Republic declares that "HONDURAS IS A STATE OF LAW", and in which are established among other things the processes of formation, enactment and promulgation of laws.
Whereas by Decree No. 363-2013 dated January 20, 2014, the Organic Law of the Legislative Branch was approved, whose numeral 4) Article 41, attributes to the Legislative Management "Organize the study of the law of parliamentary practice" and then numeral 8) "Coordinate the study, updating and coordination of legal contents to facilitate knowledge of current legislation".
Whereas to demonstrate the function of the National Congress as a generator of Law, it is imperative the action of establishing the index of national laws and a System of Search and References based on legal security and certainty that contribute to strengthening and improving the legislative function and likewise to generate confidence in the application and compliance of laws.
Whereas it is within the power of the National Congress to create, decree, interpret, reform and repeal laws.
