This law creates special courts with jurisdiction nationwide to prosecute organized crime offenses (murders, drug trafficking, kidnapping, money laundering, human trafficking, and terrorism). It benefits citizens and authorities by strengthening the fight against organized criminal groups, allowing these cases to be investigated and tried by independent, specialized judges, regardless of where the crimes occur.

Considerations

Whereas it is the responsibility of the State to guarantee the individual security of each one of the inhabitants of the country, constituting the same as a fundamental Right that must be safeguarded.

Whereas currently the rates of violence in the country reflect that a high percentage of the criminal illicit acts that occur are committed by criminal organizations, causing well-founded fear among citizens and intimidation of the authorities responsible for their prosecution and trial, through attacks against the lives of judges, prosecutors, and police officers. Likewise, as a result of the economic power that those organizations possess, they obstruct the proper administration of justice through recurring bribery of various operators to impede the outcome of criminal prosecution, thereby undermining the foundations of the Rule of Law.

Whereas the aforementioned situation merits responsible and special attention from the different sectors involved in the fight against organized crime; being members of said sectors the Judges and Magistrates of the Judicial Branch responsible for administering justice, for which it is necessary to resort to multiple mechanisms in order to effectively combat the aforementioned scourge, avoiding, in the particular case of the actors of the Judicial Branch, that acts of intimidation or external influences unrelated to the proper administration of justice obstruct that fight and appropriate situations of impunity.

Whereas the power to administer justice emanates from the People, and is administered free of charge in the name of the State, by independent Magistrates and Judges, solely subject to the Constitution and the Laws.

Whereas the Honorable Supreme Court of Justice submits before this Legislative Chamber a formal bill initiative, bringing to its knowledge the Project of SPECIAL LAW OF JURISDICTIONAL ORGANS WITH NATIONAL TERRITORIAL JURISDICTION IN CRIMINAL MATTERS, which has been prepared in respect of the constitutional principles and procedural guarantees that must be observed in the processing of criminal cases.

Whereas in accordance with Article 307 of the Constitution of the Republic, the Law, without prejudice to the independence of judges and magistrates, shall provide what is necessary in order to ensure the correct and normal functioning of the jurisdictional organs, providing effective means to meet their functional needs.

Whereas in accordance with Article 205, paragraph 1) of Decree No. 131 dated January 11, 1982, of the National Constitutional Assembly that contains the Constitution of the Republic, it is an attribute of the National Congress to create, decree, interpret, reform, and repeal laws.
