All spending will be subject to mandatory audits and public transparency.

Considerations

Whereas, in accordance with...

Whereas, the National Road Infrastructure, particularly the primary, secondary, and tertiary networks, constitutes a strategic axis for road safety, economic activity, commerce, tourism, territorial integration, and the provision of essential public services, and its deterioration is a risk factor for the population and an obstacle to national development.

Whereas, the proximity of Holy Week, a period of high vehicular mobility and internal and external tourism flow, requires the immediate adoption of exceptional measures for maintenance, patching, and road signalization, aimed at reducing traffic accidents, protecting human life, guaranteeing connectivity, and preserving the country's image as a safe tourist destination, and it is likewise necessary to carry out maintenance activities in rainwater drainage systems (gutters, channels, sewage systems, stream beds, rivers, and fords) to prevent complications such as flooding, overflow, and deterioration of infrastructure resulting from the impact of winter periods.

Whereas, a significant part of the country's Road Network is comprised of urban, rural, and productive roads under the responsibility of Municipal Governments, which present historical limitations in technical, operational, and financial capacity to adequately maintain such roads.

Whereas, the strengthening of local governments constitutes a pillar of the decentralization process, and it is the duty of the State to promote mechanisms of institutional support that allow municipalities to exercise their competencies effectively, responsibly, and transparently, without substituting their attributions or generating administrative duplication.

Whereas, the provision of machinery for Municipal Road Maintenance represents an efficient, immediate, and sustainable measure to improve the response capacity of local governments, promote territorial development, strengthen productive infrastructure, and complement the actions of the Central Government.

Whereas, it is indispensable that the exceptional measures adopted to address the National Road Emergency have clear institutional controls that provide legal security to public officials responsible for their execution and guarantee proper accountability before the State's oversight bodies.

Whereas, public interest, national urgency, the protection of human life, road safety, municipal strengthening, and economic reactivation fully justify the issuance of a Special Law, temporary and focused, that allows the immediate attention of the Road Emergency prior to Holy Week and strengthens the operational capacity of local governments, under strict mechanisms of control and transparency.
