This decree approves a contract between the National Electric Energy Company (ENEE) and Hydroenergy S.A. for Hydroenergy to build and operate the Lagunetas Phase II Power Plant, generating hydroelectric electricity to sell to ENEE for 20 years. The plant must begin operations in November 2018 and deliver approximately 105,000 megawatt-hours annually at a price of $114.14 per megawatt-hour.

Considerations

That the generation of electrical energy is of vital importance for the development of the country, requiring that the existing matrix be inverted at present, which shows prevalence with fossil fuels, whose prices are comparatively higher and fluctuate in the international market, negatively affecting the country's economy.

That the Executive Power, on July 3, 2014, through the National Electric Energy Company (ENEE), entered into an agreement with the Company HIDROENERGÍA, S.A. DE C.V. (HIDROENERGÍA), CONTRACT No. 069-2014, which contains the POWER SUPPLY AND ASSOCIATED ELECTRICAL ENERGY SUPPLY CONTRACT, for the installations of the LAGUNETAS PHASE II Plant (BAJO GRANDE), located between the municipalities of Victoria, Department of Yoro and Santa Cruz de Yojoa, Department of Cortés.

That in accordance with Attribution 19 of Article 205 of the Constitution of the Republic, it is within the power of the National Congress: To approve or disapprove contracts that involve tax exemptions, incentives and concessions or any other contract that is to produce or extend its effects to the following government period of the Republic.
