Summary
This agreement delegates the Budget Sub-Manager duties to Ciriaco Ulloa Castillo, a specialist in budget management and execution at the Management by Results Directorate. Ulloa assumes responsibility for his decisions and the agreement can be revoked at any time without affecting the budget.
Considerations
Whereas through Article 13 of Executive Decree No. PCM 05-2022 published in the Official Gazette "La Gaceta" dated April 6, 2022, the Directorate of Management by Results (DIGER) is created.
Whereas the Directorate of Management by Results (DIGER) functions as a Deconcentrated Entity of the Presidency of the Republic and is directed by an official with the rank of Secretary of State.
Whereas Article 31 of the Regulations on Organization, Functioning, and Competencies of the Executive Branch establishes, with respect to deconcentrated bodies, that technical-administrative autonomy is understood as the direct management of matters that are entrusted to them by law.
Whereas through Executive Agreement No. 127-2026, citizen ELMER MANUEL was appointed as COORDINATOR OF PLANNING AND MANAGEMENT EVALUATION AD HONOREM, in citizen ISRAEL JOSUÉ RODRÍGUEZ MOLINA, in his capacity as STRATEGIC PLANNING ADVISOR of the Directorate of Management by Results (DIGER).
Whereas the acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions, and Providences, as established in Article 116 of the General Law of Public Administration.
Whereas the Organs of the Public Administration shall conduct their activities subject to the normative hierarchy established in Article 7 of the General Law of Public Administration and in accordance with the principles of economy, diligence, and efficiency in order to achieve prompt and effective satisfaction of the general interest.
Whereas Article 116 of the General Law of Public Administration provides that: "The acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions, or Providences."
Whereas Article 122 of the General Law of Public Administration provides that: "Agreements, Resolutions, and Providences shall be signed by the head of the organ that issues them and authorized by the official indicated in the legal provisions."
Whereas Articles 4 and 5 of the Administrative Procedure Law expressly establish that "The superior organ may delegate the exercise of its functions in a specific matter to the immediately subordinate organ; and the delegation act, in addition to indicating the delegating organ, the object of the delegation may contain mandatory instructions for the latter in procedural matters. In acts issued by delegation, this circumstance shall be expressed and shall be understood as adopted by the delegating organ. Nevertheless, the responsibility that may arise from the issuance of acts shall be imputable to the delegated organ."
Articles
Delegate, as of the fourth (4) day of May of two thousand twenty-six (2026), the functions inherent to the position of BUDGET SUB-MANAGER, to FERRERA PADILLA, in the position of DIRECTOR OF MANAGEMENT BY RESULTS elevating his position with Rank of STATE SECRETARY by means of Executive Agreement No. 230-2026, with powers to issue and execute the necessary and pertinent administrative acts for the exercise of the functions. WHEREAS: The bodies of the Public Administration shall conduct their activities subject to the hierarchical normative framework established in Article 7 of the General Law of Public Administration and in accordance with the principles of economy, promptness and effectiveness in order to achieve timely and effective satisfaction of the general interest. WHEREAS: Article 116 of the General Law of Public Administration provides that: "The acts of the bodies of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions or Orders. WHEREAS: Article 122 of the General Law of Public Administration provides that: "Agreements, Resolutions and Orders shall be signed by the head of the body that issues them and authorized by the official indicated by legal provisions". WHEREAS: Articles 4 and 5 of the Administrative Procedure Law expressly establish that "The superior body may delegate the exercise of its functions in a particular matter to the body immediately below it"; citizen CIRIACO ULLOA CASTILLO, SPECIALIST MANAGER IN BUDGET MANAGEMENT AND EXECUTION with dependence on the Administrative Management of the Management by Results Directorate (DIGER).
The responsibility deriving from the decisions made in the development of the assigned functions shall be imputable to the delegated official.
This Agreement does not have budgetary effect and is subject to revocation by the appointing authority at any time.
This Agreement shall be effective immediately and must be published in the Official Gazette "La Gaceta". BE NOTIFIED AND PUBLISHED.
